AN ORDINANCE AMENDING THE CITY OF BATESVILLE, ARKANSAS FLOOD
HAZARD PREVENTION CODE, ARTICLE 4, SECTION D(10), AS ADOPTED BY
ORDINANCE # 9 /; CREATING AN APPEALS BOARD; PROVIDING FOR
APPOINTMENTS THERETO; ESTABLISHING TERMS OF OFFICE; DESIGNATING
CAUSE FOR REMOVAL; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS:
SECTION 1: That article 4 section D(10) of the City of Batesvill.E
Arkansas Flood Hazard Prevention Code as adopted by Ordinance
# � I is hereby amended to read as follows:
(10)(a) The Appeal Board shall be composed of three
residents of the City of Batesville, Arkansas,
appointed by the Mayor and approved by the City
Council. That said board members shall have the
responsibilities and duties as set out in the
Batesville, Arkansas Flood Hazard Prevention Code
and shall serve for a term of five (5) years.
(b) Appointments to the board shall be staggerd.
The initial Appeal Board shall be composed of
three (3) members, one board member serving from
September 1, 1982 to September 1, 1983, one serving
from September 1, 1982 to September 1, 1985 and
the third member serving from September 1, 1982 to
September 1, 1987. At the expiration of the term
the newly appointed member and members thereafter
appointed will serve a full five year term.
(c) In the event a board member shall resign, die,
be removed or otherwise unable to fulfill his term
Of office, the Mayor shall appoint a successor to
complete that term, with the successor being approved
by the City Council.
(d) A board member may be removed by a three-fourths
vote of the City Council, for cause.
(e) The board member whose term shall expire first
shall serve as chairman and the board member whose
term shall expire next shall serve as secretary.
(f) The board shall meet as required but not less
than once each auarter of the year. However, they
shall not be required to meet more than once each
month.
(g) The City shall provide an adequate place for
meetings of the board and supplies to conduct their
meetings; the secretary shall see that minutes of
all meeting and actions taken are recorded and filed
with the City Clerk and, if necessary, any other
public official.
(11.) All board members must be present to constitute
a quarum and all members of the board shall have
voting rights.
SECTION 2: This Ordinance shall not effect anyother part of
the City of Batesville, Arkansas Flood. Hazard Code.
SECTION 3: All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed.
