ORDINANCE
AN ORDINANCE ZONING CERTAIN PROPERTY OF VIRGIL BUTLER, SR.,
ALVIS P. BALL, NEVA B. BALL, HIS WIFE, VIRGIL BUTLER, JR..,
AND 10" BUTLER, HIS WIFE, AND J.W. COLLIER, SINGLE PERSON,
TO C-2 HI(H4AY COMERICAL, DECLARING AN EWR- rTNCY AND OTHER
PURPOSES.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BATESVILLE, ARKANSP.S
AS FOLLOWS:
1. The follouring property be and the same hereby is zoned
C-2 Highway Commercial located within the newly annexed
area of the City of Batesville, Independence County, Arkansas,
to-vAt :
TRACT ONE: Virgil Butler, Sr. -Begin on the south right of
way line of State Highway #25 at a point 226 feet east of the
quarter section corner between Sections 4 and 9-13-6, and run
thence South 4 degrees East 300 feet; thence South 86
degrees west 1122.7 feet to the east h1ghway right of Dray;
thence along said right of way south 16 1/2 degrees east
810.7 feet to a 2" iron pipe; thence north 86 degrees east
582.5 feet to a 2" iron pipe on the west right of way line
of US Highway #167; thence north 33 degrees east along said
right of way 288 feet; thence north 28 degrees 53 minutes
east 190 feet; thence north 33 degrees east 499 feet;
thence north 29 degrees 15 minutes east 344 feet to the
south right of way line of state hio way #25; thence along
said highway north 86 degrees west 100 feet; thence south
86 degrees west 300 feet to point of beginning containing
19.484 acres, more or less, in NW 1/4 NE 1/4 and NE 1/4
NW 1/4 Section 9-13-6 in Independence County, Arkansas.
Tract Two: Alvis P. Ball and Neva B. Ball, his wife -All of
the south half of the southwest quarter of the southeast
quarter of section 4, township 13 north, range 6 west, lying
north and west of highway 167 north as now located, containing
17.5 acres, more or less.
Tract Three: Virgil Butler, Jr. and Lunda Butler, his wife;
Part North half Section 9, township 13 north, range 6 west
described as follows: Beginning at a point on the south
right of way line of highway 25 that is 226 feet east and 50
feet south from the quarter section corner between sections
4 and 9, township 13 north, range 6 west; thence south 4 degrees
east 300 feet; thence south 86 degrees west 1122.7 feet to
the east right of way line of highway 69; thence north
16 1/2 degrees west along said right of way line 167 feet;
thence north 22 degrees east 144.7 feet to anoint on the
south right of way line of highway #25 that is south 86 degrees
west 1326 feet from the place of beginning; thence north
86 degrees east 1326 feet to place of beginning containing
7.8 acres. All bearings are maMetic.
TRAC'C FOUR: J.W. Collier: A part of the east 1/2 of the
NoraiweH-T/4 of section 9, township 13 north, range 6 west,
in Independence County, Arkansas, more particularly described
as follows: Beginning at a point 1141.8 feet south and 57.2
feet west from the northeast corner of the Northwest quarter
section 9, township 13 north, range 6 west, where an iron pipe
was set as a marker for the northeast corner of the tract herein
described; said point being in northwest right of way line
of US highway 167 and 70 feet normal distance from center
line; thence south 38 degrees 30 minutes west 698.6 feet
with said right of vray line to the south corner of this tract:
thence north 51 degrees 30 minutes west, 66.5 feet with
right of way to the State Highway 69 to southwest corner of
this tract; thence north 10 degrees 18 minutes west 532.3 feet
along the right of way line to northwest corner of this tract;

thence south 88 degrees 13 minutes east 582.3 feet to an
iron pin which was the point of beginning for this tract;
said tract contains 4.0 acres, more or less.
2. That the Batesville Planning Conmission has recomnended
that the above described city property be zoned C-2
highway commercial.
3. It is hereby found and declared that an eergency exists
and that this ordinance being necessary for the public
welfare, it shall be in full force and effect from the
date of its passage.
