An ordinance vacating 22nd Street in the City of Batesville,
Arkansas, between the South right-of-way line of Harrison Street
and the North right-of-way line of Fitzhugh Street in the Fitzhugh
Park Addition to the City of Batesville, Arkansas.
WHEREAS, a petition was duly filed with the City Council for
the City of Batesville, Arkansas, on the day of April,
1977, asking the City Council to vacate and abandon all that
portion of 22nd Street designated on the plat of the Fitzhugh Park
Addition to the City of Batesville, Arkansas, now appearing of
record in Deed Book I-7, Page 243 of the Independence County
Records, beginning at the South right-of-way line of Harrison
Street and ending at the North right-of-way line of Fitzhugh
Street.
WHEREAS, after due notice as required by law, the Council
has, at the time and place mentioned in the resolution, heard all
persons desiring to be heard on the question and has ascertained
that that portion of 22nd Street, hereinbefore described, has
heretofore been dedicated to the public use as a street herein
described; has not been actually used by the public generally
for a period of at least five years subsequent to the filing of
the plat; that all the owners of the property abutting upon the
portion of the street to be vacated have filed with the City
Council their written consent to such abandonment; and that the
public interest and welfare will not be adversely affected by the
abandonment of such street.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Batesville, Arkansas:
Section 1. The City of Batesville, Arkansas, hereby releases)
vacates and abandons all its rights, together with the rights of
the public generally, in and to the street designated as follows:
All that portion of 22nd Street in the City of
Batesville, Arkansas, in Fitzhugh Park Addition
lying between the South right-of-way line of
Harrison Street and the North right-of-way line
of Fitzhugh Street in the same city.
Section 2. A copy of the ordinance duly certified by the
City Clerk shall be filed in the office of the Recorder of the
County and recorded in the deed records of the county.
Section 3. It is hefteby dectaned that an emergency exists and this
