ORDINANCE NO. 7 5
AN ORDINANCE ESTABLISHING QUAIL VALLEY SEWER
IMPROVEMENT DISTRICT NO. 1
OF BATESVILLE, ARKANSAS
WHEREAS, parties claiming to be the owners of more than
a majority in assessed value of the real property located
within the territory hereinafter described have filed a
petition praying that an improvement district be established
for the purposes hereinafter set out; and
WHEREAS, after due notice as required by law, the City
Council of Batesville, Arkansas, has heard all the parties
desiring to be heard, and has ascertained that said petition
was signed by more than a majority in assessed value of the
owners of real property within said territory; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS:
SECTION 1. There is hereby established an improvement
district embracing the following property in the City of
Batesville, Arkansas, to -wit:
`'NOW Part of the Southeast Quarter cfthe Northwest Quarter
(SE4 NW4) of Section 13, Township 13 North, Range 6 West,
to -wit: Begin at a rock for the center corner of
Section 13, run N. 000 49' 53" E. along the east line of
the said SE4 NA a distance of 1025.84 ft. to the south
right-of-way line of Missouri Pacific Railroad Company;
then run N. 740 34' W. along said South Railroad right-
of-way line 652.80 ft. to a point of curvature; then run
376.29 ft. along a curve to the left, central angle
070 39' and radius 2814.94 ft. to a point of tangency,
then run N. 820 09' W. 6.51 ft.; then run S. 000 49' 53" W.
1265.44 ft. to the south line of the said SE4 NW4; then
run S. 890 19' 49" E. along the south line of the said
SEI -4 NW4 a distance of 1006.84 ft. to the point of
beginning, being 26.71 acres; and
A tract of land being part of the Northeast Quarter of the
Southwest Quarter of Section Thirteen of Township Thirteen
North and Range Six West of the Fifth Principal Meridian
(NE -14 SW4 Sec. 13, T13N, R6W, 5th P.M.) in Independence
County, Arkansas, more particularly described as follows:
... Beginning at the Center of said Sec. 13; thence S. 020
25' 35" W. along the east line of said SW4, a distance of
58.87 feet to a point on the North right-of-way line of
State Highway 69; thence beginning on S 750 16' 13" W.
on a curve to the left having a 1,949.86 foot radius along
said North right-of-way line, a curve distance of 181.56
feet; thence N. 070 58' 42" W., a distance of 122.49 feet;
thence S 870 33' 29" E. along the north line of said SW -1-4
a distance of 192.87 feet to the Point of Beginning.
Containing 0.38 acres, more or less; and
Part of the SW4, Section 13, Township 13 North, Range 6
West, to -wit: Begin at the Southeast corner of the said
SW4, run North 74 11' 49" West 284.23 ft.: then run North
680 19' 39" West 393.02 ft.; then run South 890 12' 40"
West 190.40 ft.; then run North 870 21' 00" West 1109.60
ft.; then run North 780 10' 20" West 134.20 ft.; then run
North 090 00' 00" West 1840.92 ft., to a point on the
South right-of-way line of Arkansas Highway 69; then
run Southeasterly along said South highway right-of-way
line and along a one degree curve to the left,
radius 5778.87 ft., a distance of 252.55 ft. to a
point of tangency; then run South 760 48' 38" East
along said South right-of-way line 376.19 ft.,to a
point of curvature; then run Easterly along a five -
degree forty-five minute curve to the left, radius
995.45 ft., a distance of 634.95 ft. to a point of
tangency; then run North 660 37' 54" East along said
South highway right-of-way line 1048.76 ft; then run
South 23 22' 06" East 10.00 ft. to a point of curvature
on said South highway right-of-way line; then run
Easterly along a three -degree curve to the right,
radius 1858.83 ft., a distance of 212.71 ft. to the
intersection of the said South highway right-of-way
line with the East line of the SW4, Section 13, then
run South 000 49' 52" West along the quarter -section
line 2502.27 ft., to the point of beginning, being
98 acres; and
140W The following platted lots of WOLFORD'S QUAIL VALLEY SUBDIVISION of
Part of E2 of SE4 of Section 14, and Part of Wz of SW4 of Section 13,
Township 13 North, Range 6 West:
Lots 1 to 21 inclusive, of Block One;
Lots 1 to 9, inclusive of Block Two;
Lots 1 to 11, inclusive, of Block Three;
Lots 1 to 14, inclusive, of Block Four;
Lots 1 to 10, inclusive, of Block Five;
Lots 1 to 13, inclusive, of Block Six;
Lots 1 to 10, inclusive, of Block Seven;
Lots 1 to 12, inclusive, of Block Eight;
for the purpose of constructing a system of sanitary sewer mains and
facilities to supply the inhabitants of the above described territory
with sanitary sewer service, connecting the sewer system of the
district with the sanitary sewer system of the City of Batesville,
and, in order to obtain an outlet for the sewer lines of said district,
constructing an outfall sanitary sewer line to any proper outlet
beyond the boundaries of the district; and the accomplishment of any
or all of said above purposes shall be done in such manner, at such
time, and with such materials, as the commissioners may deem to be
for the best interest of the district. The costs thereof shall be
assessed and charged upon the real property hereinabove described.
Said district shall be known as Quail Valley Sewer Improvement
District No. 1 of Batesville, Arkansas, and Terry Hotten,
Verlin Cantrell and Bennie Green are hereby named commissioners,
who shall compose the Board of Improvement for said District.
SECTION 2. This ordinance shall take effect and be in force
