HomeMy WebLinkAbout876ORDINANCE NO . _L1 (:;:, An ordinance rezoning certain property in the City of Batesville, Arkansas, lying in Section 15, Township 13 North, Range 6 West, in Independence County, Arkansas. WHEREAS, the City Planning Commission of the City of Batesville, Arkansas, has conducted a public hearing on the petition of General Investment Company for the rezoning of certain property lying in the City of Batesville, Independence County, Arkansas, and the City Planning Commission has recommended to the Batesville City Council that the following described lands lying in Independence County, Arkansas, be rezoned from commercial C-2 to residential R-3: Part of the Northwest Quarter of the Southwest Quarter Of Section 15, Township 13 North, Range 6 West, described as follows: Beginning at the Quarter Section corner to Sections 15 and 16, Township 13 North, Range 6 West, run thence South 35' along the line between said sections to the South boundary line of Harrison Street, thence East and all along the South boundary line of said Harrison Street a distance of 730'; thence South 130' to the point of beginning; thence East 951; thence South 170'; t1lence West 95'; thence North 170' to the point of beginning. WHEREAS, after due notices as required by law, the Planning Commission has heard all persons desiring to be heard on the question and has determined that the property's best use is for multifamily residential housing and that the property should be rezoned under the classification residential R-3; that other property owners in the area will not be adversely affected by the rezoning and that the general public interest and welfare will not be adversely affected by said rezoning. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Batesville, Arkansas; (1) That the lands described herein shall be rezoned under the classification residential R-3. (2) A copy of the ordinance duly filed by the City Clerk shall be filed in the Office of the Recorder of the county and recorded in the Deed Records of the county. i (3) It is hereby declared that an emergency exists, and '1 therefore, this ordinance shall take effect and be in force from and after its passage.
