0-01 _AN ORDINANCE TO AMEND THE BATESVILLE ZONING CODE; TO ELIMINATE THE
COMMERCIAL NEIGHBORHOOD DISTRICT [C-2] ZONING CLASSIFICATION; TO RECLASSIFY
PROPERTIES WITH THE C-2 ZONING CLASSIFICATION TO OTHER ZONING CLASSIFICATIONS;
AND FOR OTHER PURPOSES.
WHEREAS,the Commercial Neighborhood Commercial[C-2]zoning classification has proven to be
confusing and often controversial as a means to regulate certain kinds of commercial activities within the city of
Batesville;and,
WHEREAS,other zoning classifications of the Batesville Zoning Code accomplish the intended purposes
of the C-2 zoning classification more effectively;and,
WHEREAS,properties within the City that have a zoning classification of C-2 need to be assigned another
zoning classification which is consistent with the Comprehensive Plan;and,
WHEREAS,the Batesville Planning Commission has prepared recommendations to improve the
Batesville Zoning Code and conducted a properly advertised public hearing on September 13,2010,and
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING CODE IS HEREBY AMENDED AS
FOLLOWS:
Section 1. Revision to the Batesville Zoning Code
Section 14.07.03 is deleted in its entirety.
Section 2. Reclassification of properties
• Those properties whose zoning classification was C-2 prior to the effective date of this ordinance are hereby
reclassified as shown on Attachment A hereto,which is incorporated herein by reference.
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO BE
INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR PORTIONS OF
THIS ORDINANCE.
EMERGENCY CLAUSE:Where as it is necessary to effect the public peace,health,safety and welfare
and the orderly administration of Batesville City Codes,an emergency is hereby declared to exist and this Ordinance
shall be effective from and its passage.
