Home My WebLink About885ORDINANCE A,N ORDINANCE VACATING A PORTION OF BOSWELL STREET, CITY OF BATESVILLE, ARKANSAS AND OTHER PURPOSES WHEREAS, a petition was duly filed with the City Council of the City of Batesville, Arkansas, on the 10th day of January, 1978, asking the City Council to vacate and abandon all that portion of the street designated as follows: A tract of land consisting of the unopened full Fifty (50) foot wide by One Hundred Fifty (150) foot long street right-of-way of Boswell Street in the City of Batesville, Arkansas laying North of Lots Four (4), Five (5), and Six (6), of Block One (1) of Maxfield's Second Eastern Addition as recorded on Page 28 of Book "G-3" in the Records of Deeds, in Independence County, Arkansas. WHEREAS, after due notices as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascer- tained that the street or the portion thereof, hereinbefore de- scribed, has heretofore been dedicated to the public use as a street; has not been actually used by the public generally for a period of at least five (5) years and that public interest and welfare will not be adversely affected by the abandonment of such street. Now, Therefore, Be It Ordained by the City Council of the City of Batesville, Arkansas: Section 1: The City of Batesville, Arkansas hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: A tract of land consisting of the unopened full Fifty (50) foot wide by One Hundred Fifty (150) foot long street right-of-way of Boswell Street in the City of Batesville, Arkansas laying North of Lots Four (4), Five (5) , and Six (6) of Block One (1) of Max - field's Second Eastern Addition as recorded on Page 28 of Book "G-3" in the Records of Deeds in Independence County, Arkansas. Section 2: A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder `'of the County and recorded in the deed records of the county. Passed and approved this , day o January, 1978. r � ATTEST- MAYOR � CLERK BEFORE THE CITY COUNCIL OF BATESVILLE, ARKANSAS NOTICE OF PUBLIC HEARING Notice is hereby given that on the day of ,rv• 1978, at 7:00 P.M. there shall be held before the Batesville City Council at City Hall, Batesville, Arkansas, a public hearing on a petition filed by Nina Garrison to vacate, close and abandon a portion of Boswell Street, de- scribed as follows: A tract of land consisting of parts of the North Half of Lots Four (4), Five (5), and Six (6) in Block One (1) of Maxfield's Se- cond Eastern Addition and a section of un- opened Right-of-way of that portion of Bos- well Street laying North of said Lots, all being part of Maxfield's Second Eastern Ad- dition to the City of Batesville, Indepen- dence County, Arkansas, more particularly described as follows: Beginning at the Northeast Corner of Block One (1) of Maxfield's Second Eastern Ad- dition to the City of Batesville, Arkansas at the intersection of the South Right-of- way line of Unopened Boswell Street and the West Right-of-way line of Opened 17th Street; thence South along said West Right-of-way line, a distance of 50 feet; thence North 89042'25" W, a distance of 150.00 feet; thence North, a distance of 100.00 feet to the North Right-of-way line of Unopened Boswell Street; thence South 89042'25" E along said North Right-of-way line, a distance of 150.00 feet to a point of the West Right-of-way line of Opened 17th Street; thence South along said West Right-of-way line, a distance of 50.00 feet to the Point of Beginning. Containing 0.34 acres, more or less. Said petition further asks that the Batesville City Council should pass an ordingance vacating, closing the abandoning said portion of Boswell Street and vesting title thereto in the petitioner. All property owners affected thereby and other persons interested in or affected by such petition are hereby advised of the hearing and notified of their right to be present and to be heard.
