• AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR
OTHER PURPOSES.
WHEREAS,a number of properties were annexed into the city of Batesville by ordinance
number 2010-7-2; and,
WHEREAS,the zoning classification of said annexed properties was automatically assigned as
R-1, pending review and recommendation by the Batesville Planning Commission of permanent
classification; and,
WHEREAS, the Batesville Planning Commission has reviewed the relationship of the newly
annexed properties with the Comprehensive Plan;and,
WHEREAS,the Batesville Planning Commission has prepared recommendations to assign
permanent zoning district classifications to said annexed properties, and conducted a properly advertised
public hearing on September 13,2010.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS
HEREBY AMENDED AS FOLLOWS:
Those properties whose zoning classification was R-I immediately after their annexation into the City
of Batesville are hereby reclassified as shown on Attachment A hereto,which is incorporated herein
by reference.

IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD
TO BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION
OR PORTIONS OF THIS ORDINANCE.
EMERGENCY CLAUSE: Where as it is necessary to effect the public peace,health, safety and
welfare and the orderly administration of Batesville City Codes, an emergency is hereby declared to exist
and this Ordinance shall be effective from and its passage.

® RECOMMENDATION OF THE CITY PLANNING COMMISSION
The City Planning Commission of the City of Batesville, Arkansas, held their regular
monthly meeting on Monday, September 13, 2010, with Chairman Steven Lewis
presiding. Also present was acting Secretary Nina Womack and Commission members,
Ronnie Hampton, Ken Smith, Carma Osborn and Mike Fagan. Absent was Secretary
Brian Langston.
A Public Hearing was held on the zoning of recently annexed land into the city. The land
was all currently shown as R-1 on the Comprehensive Plan. The Planning Commission
recommending to change the default R-1 zoning to the proposed classifications by
ordinance. (see attached drawing) Comm. Hampton then made motion to recommend that
the City Council change the default R-1 to the proposed Classification of C-1 by
ordinance. The motion was seconded by Comm. Fagan and approved by vote.
Therefore, the City Planning Commission of the City of Batesville, Arkansas
recommends to the City Council of the City of Batesville, Arkansas, that the appropriate
action be taken by the City Council to carry out the recommendation of the City Planning
Commission.
