AN ORDINANCE AMENDING AND DELETING PARTS OF
ORDINANCE 659, ADOPTED, SEPTEMBER 10, ,
WHICH CREATED THE CITY PLANNING COMMISSION
AND SUBSEQUENT RULES AND REGULATIONS AS AFFECTS
THE OTHER MAATTEROSFRELATTINGNFORMING U
RESTORATION THERETO;ANDSE SIN
AND DECLARING
AN EMERGENCY.
WHEREAS, the City of Batesville, Arkansas is a
City of the first class; and
WHEREAS, by Ordinance No. 659 as enacted September
10, 1957, the Batesville City Planning Commission was created
and subsequently various rules and regulations were adopted
ertinent thereto.
WHEREAS, pursuant to this ordinance the following
language was enacted as Regulation Section 4 paragraph E., viz:
"Any structure containing a nonconforming use which

WHEREAS, The Batesville City Council now believes it
necessary to amend Ordinance 659 and delete Regulation Section
4 paragraph E language to promote the purposes of the Planning
Commission and fulfill the desire of the public.
THEREFORE BE IT RESOLVED, that the language above
described applicable to restoration of a nonconforming use struc
as defined in Ordinance 659 and subsequent regulations is hereby
deleted completely.
