AN ORDINANCE ZONING CERTAIN PROPERTY LYING NORTH OF THE CITY OF
BATESVILLE, ARKANSAS, DECLARING AN EMERGENCY AND OTHER PURPOSES.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS
AS FOLLOWS:
1. All of the property located within the newly annexed area
of the City of Batesville, Independence County, Arkansas,
said property being described on Exhibit "A" attached hereto
and incorporated herein by reference as if set out word for
word and figure for figure, be and the same hereby is zoned
"C-2" Highway Commercial, EXCEPT that the following tracts
within said area shall be and the same hereby are zoned as
set forth below:
(a) The following tracts are zoned "I-1":
(1) This tract is a part of the West 1/2 Section 10,
Township 13 North, Range 6 West in Independence
County, Arkansas, and is more particularly des-
cribed as follows: Beginning at a point 811.1'
East and 46.8' South of Northwest Corner of Sec.
10-13-6, said point being the Northwest Corner of
the tract herein described, the Northeast Corner
of Barnett & Landers tract, and in the South R/W
line of Hwy. 394 where an iron pipe was set for
marker; thence S 88025' E 603.0' with said R/W
line to the Northeast corner of this tract and the
Northwest corner of Chamber of Commerce tract where
an iron pipe was set for marker; thence South 545.0'
with West line of C of C tract to the Southeast
corner of this tract and Northeast corner of West-
port Addition Tract where an iron pipe was set for
marker; thence N 88025' W 184.1' with North line
of Westport Addition to top of stream bank where
an iron pipe was set for marker; thence continuing
with North line of Westport Addition N 88025' W
418.9' for total distance of 603.0' to the South-
west corner of this tract and the Northwest corner
of Westport Addition where an iron pipe was set
for marker; thence North 545.0' with East line of
Barnett & Landers tract to the point of beginning,
the Northwest corner of this tract, said tract
containing 7.54 acres, more or less. Bearings are
true.
(2) Part of the West Half (W 1/2) of Section 10,
Township 13 North, Range 6 West, described as fol-
lows: Beginning at a point on West line of Highway
167, said point being 106 feet West and 659 feet
and 10 1/2" South from the Quarter Section corner
between Sections 3 and 10, said point being also
the Southeast corner of the Felts Motel tract (see
deed recorded Book Y-6, page 381); thence North
84 degrees West along the South line of said tract
and extension thereof 861 feet to a point; thence
South 200 feet to a point; thence West 300 feet to

a point; thence South 200 feet to a point; thence j
West 914 feet to a point on the East right-of-way
line of Missouri Pacific Railroad; thence along
said East Right-of-way line, South 36 degrees East
1300 feet and South 32 degrees East 1120 feet to
the West Right-of-way line of Highway 167; thence
along said West right-of-way line North 32 degrees
East 900 feet, thence North 21 degrees East 300
feet; thence North 15 degrees East 483 feet; thence,
North 800 feet to place of beginning, containing
56.2 acres, more or less, all lying in Independence:
County, Arkansas.
(b) The following tracts are zoned "R-2":
(1) Lot 2, Block 1 and all of Block 2 of Butlerwood
Sub -division;
(2) A part of the SE 1/4 of SW 1/4 of Section 3, Twp.
13 North, Range 6 West, described as follows:
Beginning at a point on the North side of a County
Road 19 feet North and 368 feet West from the SE
corner of the said SE 1/4 SW 1/4, thence North 210
feet to a certain Fence; thence West and with the
said fence 175 feet to the East line of the Connell
tract; thence South and with the said East line 210
feet to the North side of the County Road aforesaid;
thence East and with the said North side 175 feet to
the place of beginning, containing 0.84 acres more
or less.
(3) A part of the Southeast Quarter (SE 1/4) of the
Southwest Quarter (SW 1/4) of Section 3, Township
13 North, Range 6 West, described thus:
Commencing at a point 654 feet West of the Southeast
corner of said Southeast Quarter (SE 1/4) of South-
west Quarter (SW 1/4), section, township and range
aforesaid; (this point also being the Southwest
corner of a tract of land conveyed by Richard E.
Connell to W. H. Ford and Mary Ford); thence North
210 feet; thence West 260 feet; this line being
parallel with the South line of said forty; thence
South 210 feet to the South line of said forty acres
tract; thence East along said line 260 feet to the
point of beginning.
(4) A part of the Southeast Quarter of the Southwest
Quarter of Section 3, Township 13 North, Range 6
West, described thus:
Commencing at a point 494 feet West of the South-
east corner of said SE 1/4 of SW 1/4, Section,
Township and Range aforesaid, run thence North 210
feet; thence West and parallel with South line of
said Forty 160 feet to a point; thence South 210
feet to South line of said Forty acre tract; thence;.
East along said line 160 feet to the point of be-
ginning, containing the East 160 feet of land
conveyed in the deed from C. L. Robertson and wife
to Richard E. Connell and Minnie Lee Connell on
April 2, 1955 by deed recorded in Deed Book Y-6 at
pages 307-308.
(5) A tract of land being part of the SE 1/4 of the
SW 1/4 of Sec. 3 in T 13 N, R 6 W of the 5th PM in
Independence County, Arkansas, more particularly
described as follows:
Commencing at the Southwest corner of said Sec. 3;
j' thence East, a distance of 1834.5 feet; thence
i North, a distance of 193.9 feet:to the Point of
Beginning; thence S 88019' E, a distance of 420.0
feet; thence N 06008' E, a distance of 285.0 feet;
thence N 88019' W, a distance of 215.0 feet6 thence
North, a distance of 60.0 feet; thence N 63 441 Vd,
a distance of 57.8 feet to a branch; thence S 35009';
W along said branch, a distance of 47.6 feet; thence
S 38041' W along said branch, a distance of 196.2
feet; thence S 04051' W along said branch a distance;
of 63.1 feet; thence S 47017' W along said branch,
a distance of 38.4 feet; thence S 000021 W, a dis-
tance of 82.0 feet to the Point of Beginning.
Containing 2.72 acres, more or less.
2. That the Batesville Planning Commission has recommended that
the above described city property be zoned as set forth above.;
3. It is hereby found and declared that an emergency exists and
that this ordinance being necessary for the public welfare,
it shall be in full force and effect from the date of its
passage.
