HomeMy WebLinkAbout898ORDINANCE NO. ?C AN ORDINANCE VACATING AND ABANDONING 10TH STREET BETWEEN NEELEY AND BYERS STREETS WHEREAS, a petition was duly filed with the City Council for Batesville, Independence County, Arkansas, on December 12, 1978, asking the City Council to vacate and abandon 10th Street between 1 s Neeley and Byers Streets in the City of Batesville, Independence County, Arkansas; and WHEREAS, after due notice as required by law, the City Council s, at the time and place mentioned in the notice, heard all 3ersons desiring to be heard on the question and has ascertained: 1. That 10th Street between Neeley Street and Byers Street in Batesville, Independence County, Arkansas, has heretofore been dedicated to the public use as a street herein described. 2. That all of the owners of the property abutting upon 10th Street between Neeley Street and Byers Street in Batesville, independence County, Arkansas, has consented to such vacation and andonment. 3. That the public interest and welfare will not be adversel ffected by the vacation and abandonment of the street; that 10th treet between Neeley Street and Byers Street in Batesville, Independence County, Arkansas is not required for any corporate se; and 4. 10th Street between Neeley Street and Byers Street in tesville, Independence County, Arkansas has never been opened Has a right-of-way to the public and has not been used by or for public as a street or alley for a period of more than five ears last past; and 5. That no public inconvenience will result from the closing. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TESVILLE, ARKANSAS: Section 1. The City of Batesville, Arkansas, hereby releases, vacates, and abandons al l i is ri ghts, together wi th the ri ghts of the public generally, in and to 10th Street between Neeley Street and Byers Street in Batesville -,Independence County, Arkansas, and absolute ownership of 10th Street between Neeley Street and Byers Street in Batesville, Independence County, Arkansas shall vest in Doyle W. Rogers and Josephine Raye Rogers, his wife, and Malcom Moore and Edith Moore, his wife, the owners of the property abutting 10th Street between Neeley Street and Byers Street in Bate svi 11e, Arkansas. Section 2. A copy of this ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of ,Batesville, Independence County, Arkansas, in the deed records lof Independence County, Arkansas.
