HomeMy WebLinkAbout899BEFORE THE CITY COUNCIL FOR THE CITY OF BATESVILLE, ARKANSAS ORDINANCE NO. �919 AN ORDINANCE VACATING FXNCH STREET IN QUAIL VALLEY ADDITION TO THE CITY OF BATESVILLE, ARKANSAS WHEREAS, a Petitionwas duly filed with the City Council for the City of Batesville, Arkansas, on the 12th day of December, 1978, asking the City Council to vacate and abandon all that portion of the street designated as Finch Street on the plat of Quail Valley Addition to the City of Batesville, Arkansas, appearing in Record Book M-11, page 629, beginning at Robin Street and ending at Mockingbird Street, and WHEREAS, after due notices as required by law, Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street hereinbefore described has heretofore been dedicated to the public use as a street; has not been actually used by the public; that all the owners of the property abutting on the portion of the street to be vacated have filed the Petition to such abandonment; that the public interest and welfare will not be adversely affected by the abandonment of such street. NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Batesville, Arkansas: SECTION I. The City of Batesville, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: Finch Street as shown platted in Book M-11, page 629 of the Independence County Records, beginning at Robin Street and ending at Mockingbird Street. SECTION II. A copy of the Ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of the County and recorded in the Deed Records of the County. SECTIO11 Ill.
