AN ORDINANCE AMENDING ORDINANCE NO. 717 AND ORDINANCE NO. 816, REGULATING THE USE OF SEWERS AND DRAINS, PRIVATE SEWAGE DISPOSAL, THE INSTALLATION AND CONSTRUCTION OF BUILDING SEWERS, AND DISCHARGE OF WATERS AND WASTE INTO THE PUBLIC SEWER SYSTEMS,AND PROVIDING PENALTIES FOR VIOLATION THEREOF IN THE CITY OF BATESVILLE, COUNTY OF INDEPENDENCE, AND STATE OF ARKANSAS. WHEREAS, it is necessary for the City of Batesville, Arkansas, to comply with the laws of the United States of America, and of the State of Arkansas, and regulations promulgate thereunder for the control of pollution in streams and rivers, for the safety and welfare of the public; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Batesville, Arkansas, in regular session assembled, as follows: SECTION I: Batesville City Ordinance No. 717 (December, 1965) shall be modified as follows: Article V, Section 4(i) of the aforesaid ordinance is hereby amended by substitution of the following provisions for the entirety of the aforementioned provisions as originally ordained in the aforesaid ordinance, to -wit: 4(i) MATERIALS, 1. Which cause or exert unusual concentrations of inert suspended solids (including, but not limited to, Fullers earth, lime slurries, and lime residues) or of dissolved solids (including, but not limited to, sodium chloride and sodium sulfate). 2. Which cause or exert excessive discoloration (including, but not limited to, dye waste and vegetable tanning solutions). I! ti 3. Which contain in excess of 270 miligrams ii f' i. per liter of suspended solids or in excess of 30 miligrams per liter of sulfates. 4. Which contain concentrations of waste having in excess of 270 milligrams per liter biochemical oxygen demand (BOD). 5. Which exert or cause unusual volume of flow or concentration of wastes constitut- ing "slugs" as defined herein. Concentrations of wastes discharged to the sewer system in excess of that named in Article V, Section 4(i)(3) and 4(i)(4) above up to 350 milligrams per liter of suspended solids or 350 milligrams per liter BOD will be subject to a surcharge to be assessed under a separate city ordinance. Water users discharging waste in excess of 350 milligrams per liter BOD or 350 milligrams per liter of suspended solids must provide pre- treatment to a level of 350 milligrams per liter BOD and 350 milligrams per liter of suspended solids, or less, for both suspended solids and BOD, unless specifically exempted by separate city action. SECTION II: Batesville City Ordinance No. 816 (July, 1972) shall be modified as follows: (a) Section 2 of the aforesaid Ordinance No. 816 modifying Section 3(b) of Article V of Ordinance No. 717 shall be, and is hereby, modified by striking therefrom the words in the final phrase of said subsection "including but not limited to cyanides in excess of 0.003 as CN in the waste as discharged to the public sewer". The aforesaid Ordinance No. 717 shall be, and is hereby restored to its original form, except for striking therefrom in the final phrase of said subsection the words "including but not limited to cyanides in excess of two (2) milligrams per liter as CN in the waste as discharged to the public sewer". (b) Section VI of Ordinance No. 816 should be, and is hereby amended to substitute for Section VI of Ordinance No. 816 the following section, to -wit: - 2 - cm The maximum permissible limits for the following described metals are here established. ELEMENT CONCENTRATION (mg/1)* Arsenic 0.05 Barium 5.00 Boron 1.00 Cadmium 0.02 Chromium 0.05 Copper 0.02 Lead 0.10 Manganese 0.5 Mercury 0.002 Nickel 0.08 Selenium 0.02 Silver 0.01 Zinc 0.05 MAXIMUM LIMITS (mg/l 0.05 5.00 1.00 0.02 0.50 0.20 0.10 1.00 0.005 0.80 0.02 0.10 0.50 If at least a tenfold dilution is available in a receiving sewer system at its absolute minimum flow, these allowable values may be increased tenfold, but no more. Under no circumstances will more than 0.05 parts per million CN be discharged to a sewer or stream. If discharge to a sewer or stream is contemplated on any of the metals described bebw, reference should be made to the Arkansas Pollution Control Commission for guidance. Said metals are: Antimony, Beryllium, Bismuth, Cobalt, Iron, Molybdenum, Rhenium, Strontium, Tellurium, Tin and Uranylion SECTION III: The City Council of the City of Batesvillf Arkansas hereby finds that there is an immediate and urgent need for the prompt passage of this ordinance for the proper administration of municipal affairs in advancing with a sewer improvement project funded in part by a grant from the United States of America, and in order to comply with regulations governing such grants; therefore, an emergency exists, and this ordinance being necessary for the protection of the public peace, health, safety and welfare, shall take effect and be in force from and after its passage, approval and publication.
