HomeMy WebLinkAbout906ORDINANCE NO. AN ORDINANCE ESTABLISHING AN INDUSTRIAL COST RECOVERY SYSTEM FOR THE BATESVILLE, ARKANSAS WASTEWATER PUMPING AND TREATMENT SYSTEM. WHEREAS, the City of Batesville, Arkansas is charged with the responsibilities of operating and maintaining the Batesville Wastewater System in accordance with all applicable local, state and federal laws; and w WHEREAS, the U. S. Environmental Protection Agency (EPA) hasrequired as a grant condition for the receipt of grant funds (EPA Project No. C--05-0332-03) to finance in part the il. Batesville Wastewater Pumping and Treatment System, that an f Industrial Cost Recovery System be developed by the grantee, ii the City of Batesville through its operating agent, the Batesvill ii Utilities Commission; and WHEREAS, the Industrial Cost Recovery System must comply with published regulations under Public Law 92-500 which i stipulates that "any non-governmental user of publicly owned {� treatment works identified in the Standard Industrial Classification !j ji Manual, 1972, Office of Management and Budget, as amended and i supplemented, under the following divisions: (a) Division A. - Agriculture, Forestry & Fishing �I (b) Division B. - Mining j f (c) Division D. - Manufacturing I (d) Division E. - Transportation, Communications Electric, Gas & Sanitary Services (e) Division I. - Services" i f, is subject to provisions of the Industrial Cost Recovery System ,i as described hereinafter; and WHEREAS, a user in the Industrial Divisions previously listed may be excluded if it is determined that it will introduce primarily segregated domestic wastes or wastes from sanitary conveniences. i ! j NOW, THEREFORE, BE IT ORDAINED that the City of Batesville, Arkansas fixes and establishes that: (1) domestic type wastewaters are defined by 1 Batesville City Ordinance No. 905 as those which are I shown to exhibit strength characteristics not exceeding 270 mg/l biochemical oxygen demand (BOD), '4 270 mg/1 suspended solids, at any hydraulic flow rate, or exhibiting any other characteristics which i' i are not normally constituents of domestic wastewater; (2) any industrial or commercial user which i. discharges wastes into the Batesville Wastewater System in excess of 50,000 gallons per day, whether '! equalized or not, and the characteristics of same wastes may be less than those defined above in (1) i shall likewise pay the Industrial Cost Recovery ;i ii Charge as delineated hereinafter; j (3) the discharge characteristics of any industrial or commercial customer exceeding the j ii limits previously stipulated in either (1) and/or (2) above shall pay an industrial cost recovery charge based on its pro --rata share of the capital costs of construction of the Batesville Wastewater 1. Pumping and Treatment System in addition to thF: i normal monthly sewer user charge. (4) any industrial concern whose hydraulic, i chemical, or biochemical characteristics do not exceed the previously defined limits of (1) and/or i� (2) above will not be required to pay industrial cost recovery charges; (5) the industrial cost recovery charge as applied initially to existing industries will be ii modified and redistributed as additional qualifying ii industries are connected to the wastewater system and as a minimum for all industrial users on a i' yearly basis; i! - 2 - low -41W r (6) each affected industrial discharge shall f be monitored on a periodic basis but as a minimum once each year to determine flows and loadings; (7) the method of determining the applicable industrial cost recoverT charge shall be in accordance with latest EPA published regulations; (8) all industries affected by this resolution shall have, upon receipt of written notification from the Utilities Commission of a change in ICR i costs, 30 days in which to appeal to the Board the stipulated changes in ICR costs. jj (9) any industry subject to ICR charges may i y remit to the Utilities Commission the appropriately i i' computed charges on either a monthly, quarterly, or, ;� LL as a maximum, on a yearly basis. i! BE IT ORDAINED that the City of Batesville fixes and g neral equations to be used in establishes the following, geq computing and allocating Industrial Cost Recovery charges that shall be paid by all qualifying users of the Batesville Waste- �I ;! water System as previously defined, said charges becoming effective fiscal year beginning October 1, 1980. 'f Plant Design SS, Lbs. q i Total Yearly ICR Charges = Equation (1) + Equation (2) + Equation' It is hereby ascertained and declared that the fore - going measures are necessary to comply with State and Federal Lawj , 4 and to insure continuing qualification of EPA Project No. C-05- 0332-03 for federal _funding.
