AN ORDINANCE PROHIBITING THE DEPOSIT OF RUBBISH, TRASH, LUMBER, SOIL OR OTHER MATERIALS IN DRAINAGE DITCHES LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY OF BATESVILLE; PROVIDING PENALTIES THEREFOR; AND FOR OTHER PURPOSES: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE: SECTION 1. It shall be unlawful for any person, persons, firm, company or corporation to place or deposit or cause to be placed or deposited in any storm drain, ditch, gutter or other drain, whether natural or artificial, that carries storm or other surface water, within the City of Batesville, any trash timber, lumber, shingles, planks, bricks, rocks, soil or any other material or rubbish which may obstruct the free flow of water therein or cause water to divert out of said drain or cause water to become stagnant. SECTION 2. Any person, persons, firm, company or corporation who shall violate Section 1 of this ordinance shall be deemed guilty of a misdemeanor and on conviction shall be fined in any sum not less than ten ($10.00) dollars nor more than two hundred fifty ($250.00) dollars with each day of violation of this ordinance being a separate offense of said ordinance. SECTION 3. Any ordinance or part of ordinance in conflict herewith is hereby repealed. SECTION 4. If any section, sentence or portion of this ordinance is for reason held invalid or unconstitutional by any court of competent jurisdiction such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. This ordinance being necessary for the prevention of health hazards and for the protection of the city streets and highways and further necessary for the protection of the health, safety and welfare of the citizens of Batesville, 11 Arkansas, an emergency is declared to exist and this ordinance shall take ef- fect and be in force from and after the4e of passage.
