ORDINANCE NO.
ORDINANCE WITH REFERENCE TO REZONING OF PROPERTY OWNED BY THE
SHOPPERS COMPANY, AN ARKANSAS GENERAL PARTNERSHIP.
WHEREAS, the City Planning Commission of the City of Batesvilie,
Arkansas, pursuant to law, has filed its recommendations with the
City Council recommending that the following action be made with
reference to the proposed reclassification of the property involve
herein, that the following described property owned by the Shopper
Company, an Arkansas General Partnership, to -wit:
Part of the Southeast Quarter (SE4) of the Northeast
Quarter (NE4) of Section 16, Township 13 North, Range
6 West, and described as follows: Beginning at quarter
section corner between Sections 15 and 16 in aforesaid
township and range in center of Harrison Street; thence
North 25 feet to North side of Harrison Street; thence
North 550 feet for place of beginning of this conveyance;
thence West 60 feet; thence North 100 feet; thence East
60 feet; thence South 100 feet to place of beginning,
be classified as highway commercial zoning district C-2; that said
proposed change would be to the best interest of the City of
Batesville;
NOW, THEREFORE, be it ordained by the City Council of the
City of Batesville, Arkansas:
Section 1. That the City Council adopt the
report and recommendation of the City Planning
Commission as above set forth and that the lands
as above described be, and they are hereby,
classified under the applicable zoning law and
regulations of the City of Batesville, Arkansas,
as highway commercial zoning district C-2.
Section 2. That the City Clerk shall cause
the official zoning map to note the change as
above set forth.
Section 3. That there is hereby found and
declared to be an immediate need for the reclas-
sification as above set forth for the benefit of
the public health, safety and welfare of the City
of Batesville, Arkansas, and particularly the
area affected hereby.
NOW, THEREFORE, it is declared that an emergency exists and
that this ordinance is necessary for the immediate preservation
,of the public health, safety and welfare and shall be enforced and
shall take effect immediately upon an Taft r its assage.

RECOMMENDATIONS OF THE CITY PLANNING COMMISSION
The City Planning Commission of the City of Batesville,
sas, ;veld its regular monthly meeting on Tuesday, I -larch 4,
1975, with Chairman Charles Barnett presiding. Also present
e Secretary Virginia Kirk, and Corunission members Frances
Williams, uoanie A. ` im Boylan and Dr. O. E.. Jones, Jr.
A hearing was had with refurence to the petition filed by the
Shoppers Company, an Arkansas General Partnership co::iposed of 4131. L.
Bell, R. Z�. `�raicg, Toward y�. iao�:se, :eith Sys an,! Bob Slaughter
asking for t *.(: rezoning of tale following described property,
to -wit:
Pare: of the Southeast Quartar (SL'4-) of the °lortheast
Qaarter (NEE) of Section 16, Township 13 North, Range
6 West, and described as follows: Beginning at quarter
section corner between Sections 15 and 16 in aforesaid
township and range in center of iTarrison Street; thence
North 25 feet to North sici of ITarrison Street; thence
North 550 feet for place o:` beginning of this conveyance;

The petition sought the rezoning of the above described
property from a residential -21 district to a co',"ibmer_cial C-2
Idistrict.
The Shoppers Company �,as r�_�t)resented by Samuel C. i�ighsmith,
its attorney. Presented to :he Corn-nission was a plat showing the
use of the property and the ComaTiAssion was advised that the
adjacent tract of land had been rezoned by the City of Batesville
in 24ovember of 1974. Also presented to the Commission was a proof
of publication showing that the notice of public hearing had been
given more than 15 days prior to the date set for laearing, and
there were no protestants present.
After the matters were presented to the Commission, Commis-
sioner Williams moved that the Commission recommend to the City
Council of the City of Datesville, Arkansas, that the applica-
tion for rezoning be approved. 'she motion was seconded by
Commissioner Jones, and upon a vote of the Commission was passed
unanimously.
The City Planning Commission of the City of Batesville,
Arkansas, recorxnends to the City Council of the City of Batesville,
Arkansas, that the petition as filed by the Shoppers Co:,-.r)aay be
granted and that appropriate action be taken by the City Council
to carry out the recommencia�ions of the City Planning Corwmission.
