HomeMy WebLinkAbout858ORDINANCE NO. AN ORDINANCE TO ACCEPT THE ANNEXATION OF CERTAIN LANDS TO THE CITY OF BATES- VILLE, ARKANSAS. WHEREAS, a petition has been filed in the County Court of Independence County, Arkansas, petitioning for the annexation of certain contiguous lands to the City of Batesville, Arkansas, which lands are hereinafter specifically described, and which land were, after hearing preceded by due publication of notice thereof, on the 3rd day of August, 1976, ordered annexed to the City of Batesville, Arkansas; and, WHEREAS, more than thirty (30) days have elapsed following the order of annexation without objection thereto being filed with the County Court and on the day of September, 1976, the Independence County Court did by order of that date confirm the annexation of said lands to the City of Batesville, Arkansas; and, WHEREAS, the City Council of the City of Batesville, Arkansas, finds that the annexation of such lands should be accepted by the City of Batesville, Arkansas. NOW, THEREFORE, BE ORDAINED AND ENACTED BY THE City Council of the City of Batesville, Arkansas: 1. That the City of Batesville, Arkansas, does hereby accept the annexation of the following described lands: A part of the Southwest Quarter of the Southeast Quarter of Section 15, Township 13 North, Range 6 West, described as follows: Beginning at the Northwest corner of said Southwest Quarter of the Southeast Quarter, thence East 759 links (500.94 ft.), thence South 26 1/2 degrees West 799 links (527.34 ft.), thence North 75 3/4 degrees West 418 links (275.88 ft.) to the line dividing the Southeast Quarter and the Southwest Quarter of said Section 15, thence North on said line 604 links (398.64 ft.) to place of beginning, containing four (4) acres, more or less. And a part of the Northwest Quarter of the Southeast Quarter of Section 15, Township 13 North, Range 6 West, described as follows: Beginning at the Southwest corner of said Northwest Quarter of the Southeast Quarter, thence East 759 links (500.94 ft.) to South side of State Highway No. 69, thence in a Northwesterly direction along South and West side of said Highway to intersection of line dividing the Southeast Quarter of the Southwest Quarter, of said Section 15, thence South on said line 800 links (528 ft.) to place of beginning, containing two and one-half (_2 1/2) acres, more or less. A part of the Southwest Quarter of the Southeast Quarter of Section 15, Township 13 North, Range 6 West, described by metes and bounds as follows: Beginning at the Northwest corner of said Southwest Quarter of the Southeast Quarter, thence South 604 links (398.64 ft.) to the Southwest corner of a 4 -acre tract deeded to W. H. Handford, June 6, 1945 by Mrs. Myrtle McCormack as shown in Deed Record Y-5, page 580 for the beginning point of this conveyance, thence in a Southeasterly direction along and adjacent to the South boundary line of said 4 -acre tract 418 links (275.88 ft.) to a point, thence South 26 1/2 degrees West 410 links (270.6 ft.) thence North 75 3/4 degrees West 157 links (103.62 ft.) more or less, to a point o n quarter section line 300 links (198 ft.) South of the beginning point of this conveyance; thence north on Quarter Section line 300 links (198 ft.) to the beginning point of this conveyance, containing in said tract 1 1/8 acres, more or less, and reserving and excepting for ourselves (the Brown) a 15 foot strip off the entire West side of the above described tract, leaving in the above conveyance to said grantee herein (W. H. Handford) 1 acre, more or less. 2. That attached hereto as Exhibit 11A" and made a part hereof by reference thereto is a plat of the above-described lands, the annexation of which to the City of Batesville, Arkansas is hereby accepted. 3. It has been determined that the proper zoning contro of the lands of the City of Batesville is necessary for the preservation of the public peace, health and safety and that the acceptance of this annexation should be immediately effected in order that such zoning control may be exercised. Therefore, this ordinance being necessary for the immediate preservation of the public peace, health and safety an emergency is hereby declared to exist and this ordinance shall be in full Force and effect immediately upon its passage.
