Whereas the Batesville Utilities Commission has caused to be made a study of sewer conditions in the City of Batesville, and Whereas the sewer system is in need of additional revenue; Now therefore be it ordained by the City Council of Batesville, Arkansas as follows: Section One: NEW RATES ESTABLISHED: Ordinance No. 740, Section One, is hereby amended as follows: That the following monthly rates be, and are hereby fixed as rates to be charged for services furnished by the Sanitary Sewer System of the City, which rates the City Council hereby finds to be reasonable minimum rates to be charged: (a) Monthly sewer charges shall be based upon water consumption. The sewer committee shall classify all customers of the Sanitary Sewer System (customer being hereby defined as any landowner whose buildings �,. or premises are connected with and use the Sanitary Sewer System of the City or otherwise dischargesanitary sewage, industrial waste, water or other liquids either directly or indirectly into the Sanitary Sewer System of the City) as either domestic or commercial on the basis of whethett the water consumption for the individual customer is used for domestic or commercial purposes. In the case of domestic users, the the average monthly water consumption for the months of January, February, March, October, November and December of the calender year preceding that in which sewer bills are rendered shall be computed separately for each domestic customer and a uniform monthly charge for each domestic customer shall be determined by applying the following schedule of rates to the average monthly water consumption so computed. In the case of Connercial users, the monthly water consumption for the month in which the sewer bills are rendered shall be computed separately for each commercial customer and the sewer charge for each commercial customer shall be determined by applying the following schedule of rates to the monthly water consumption so computed; provided that in the case of a commercial customer using an,appreciable amount of water that does not reach the Sanitary ;ewer System, the Sewer Committee, upon request by such commercial customer, shall determine the percentage of the total water usage that does reach the Sanitary Sewer System and the following schedule shall be applied to that percentage. The following schedule of rates shall be applied: (1) All residential customers and commercial customers inside the city limits using no more that the minimum billing quantity of water shall pay an amount equal to 75% of said minimum water charge as sewer charge. .. (2) All residential customers and commercial customers inside the city limits using a quantity of water greater than the minimum billing quantity of water shall pay an amount equal to 90111o" of the water charge for all water used as sewer charge. (3) Residential and commercial customers outside the city limits who are customers of the Waterworks System of the City shall pay monthly sewer charges based upon water consumption and the following schedule of rates shall apply to All such customers: The rate charged for sewer use shall be 150 of the monthly water bill. (4) Residential customers outside the city limits who are not customers of the Waterworks System of the City shall pay a monthly sewer charge of $10.00 per house. SECTION TWO: No other part of Section One of Ordinance No. 740 is amended nor is any other part of Ordinance No. 740 amended. SECTION THREE: Because it is necessary to put all sewer use on a sound fiscal policy and to avoid loss of revenues, an emergency is hereby declared and this Ordinance shall be in full force and effect from and after its passage.
