AN ORDINANCE DESIGNATING ZONING CLASSIFICATION
OF HEREINAFTER DESCRIBED PROPERTY SITUATED IN
THE CITY OF BATESVILLE, ARKANSAS
WHEREAS, the City Planning Commission of the City of
Batesville, Arkansas, pursuant to law, has filed its recommenda-
tion with the City Council recommending that the following action
be made with the proposed designation of zoning classification of
the property owned by Dolph Pegg and Sylvia Pegg, his wife, which
property is described as follows:
TRACT I. A part of the Northwest Quarter of the
Northwest Quarter of Section 22, Township 13
North, Range 6 West, described as follows:
Beginning at the Southwest Corner of said NW 1/4
N1q 1/4, said Section, Township and Range; thence
East along the South line of said NW NW 1/4
660 feet; thence North a distance of 165 feet to
a point; thence West 660 feet and parallel with
the South line of said NW -1/4 NW -1/4 to a point
on the West line of said NW -1/4 NW -1/4 a distance
of 165 feet North of the beginning point; thence
South a distance of 165 feet to the point of
beginning, containing 2-1/2 acres, more or less.
TRACT II. A part of the Northwest Quarter of the
Northwest Quarter of Section 221 Township 13 North, '
Range 6 West, described as follows: Beginning
at the Southwest Corner of said Northwest Quarter
of the Northwest Quarter of said Section, Town-
ship and Range; thence North along the West line
of said Northwest Quarter of the Northwest Quarter
1,540 links to the Southwest corner of the
Country Club property, being the point of begin-
ning of the tract herein conveyed; thence East
660 feet; thence South 851.4 feet to the North
line of the property conveyed by the grantors
herein to Charles Goff and Betty Goff, his wife,
on February 25, 19693 by deed recorded in Deed
Book J-9, at page 263; thence West 660 feet to the
West line of said Northwest Quarter of said
Northwest Quarter; thence North 851.4 feet, more
or less, to the point of b4 nning.
at same being designated as "R-1" Residential Zone and that
(said proposed designation is to the best interest of the City of
atesville;
NOW, THEREFORE, Be It Ordained by the City Council of
he City of Batesville, Arkansas:
I.
That the City Council adopt the report and recommenda-
tion of the City Planning Commission as above set forth and that
the lands hereinabove described be and are hereby classified under
the applicable zoning law and regulation to the classification of
"R-1" Residential Zone.
II.
That the City Clerk shall cause the official zoning map
to note the change as above set forth.
That there is hereby found and declared to be an
immediate need for the classification as above set forth for the
benefit of the public health, safety and welfare of the City of
Batesville, Arkansas, and the area affected hereby. It is there-
fore declared that an emergency exists and this ordinance is
necessary for the immediate preservation of the public health,
peace, safety, welfare and shall be in force and shall take
effect immediately upon and after its passage.

RECOMMENDATION OF CITY PLANNING COMMISSION
OF BATESVILLE, ARKANSAS
TO: CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS
A special meeting of the City Planning Commission of
Batesville, Arkansas, was held on Tuesday, July 18, 1972, at
7:00 P.M., at the City Hall, Batesville, Arkansas. Notice of
the meeting was waived by all members of the City Planning
Commission and a quorum of the City Planning Commission was
present at this time.
The petition and amended petition of DOLPH PEGG and
SYLVIA PEGG for the classification and zoning of the following
described land:
Tract 1: A part of the Northwest Quarter of the
Northwest Quarter of Section 22, Township 13
North, Range 6 West, described as follows:
Beginning at the Southwest corner of said
Northwest Quarter of the Northwest Quarter,
said Section, Township and Range; thence
East along the South line of said NW NW -1/4
660 feet; thence North a distance of 165 feet to
a point; thence West 660 feet and parallel with the
South line of said NW -1/4 NW -1/4 to a point on the West
line of said NW -1/4 NW1/4 a distance of 165 feet north
of the beginning point; thence South a distance of 165
feet to the point of beginning; containing 2-1/2
acres, more or less.
Tract II: A part of the Norghwest quarter of the North
west Quarter of Section 22, Township 13 North, Range
6 West, described as follows: Beginning at the South-
west Corner of said northwest Quarter of the Northwest
Quarter of said Section, Township and Range; thence North
along the West line of said Northwest Quarter of the
Northwest Quarter 1.540 links to the Southwest corner
of the Country Club property, being the point of beginn
ing of the tract herein conveyed; thence East 660 feet;
Thence South 851.4 feet to the North line of the property
conveyed by the grantors herein to Charles Goff and
Betty Goff, his wife, on February 25, 1969, by deed
recorded in Deed Book J-9, at page 263; thence West
660 feet to the West line of said Northwest Quarter of
said Northwest Quarter; thence North 851.4 feet, more
or less, to the point of beginning.
was had and it was developed that proper notice of the hearing
had been given by publication in the Batesville Guard; that no
objections or exceptions to the petition were made; that the
propertyabove decribed is not zoned at the present time; and that
la proper zoning of this tract would be "R-1" residential zoning
classification; that there was evidence presented in favor of
said classification with no evidence against said classification;
and the commission finds that it is to the best interest of the
City of Batesville that the property be zoned "R -l" residential
and recommends that an appropriate ordinance be enacted by the
City of Batesville to this effect.
