HomeMy WebLinkAbout816ORDINANCE NO. c, li/ AN ORDINANCE AMENDING ORDINANCE NO. 717 REGULATING THE USE OF PUBLIC AND PRIVATE SEWERS AND DRAINS, PRIVATE SEWAGE DIS- POSAL, THE INSTALLATION AND CONNECTION OF BUILDING SEWERS, AND THE DISCHARGE OF WATERS AND WASTES INTO THE PUBLIC SEWER SYSTEMS: AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF: IN THE CITY OF BATESVILLE, COUNTY OF INDEPENDENCE, STATE OF ARKANSAS. WHEREAS, the cost to the City of Batesville, Arkansas, for handling excessive solids and sludge and for increased facilities to improve biological treatment greatly exceeds the cost for processing normal domestic sewage; and WHEREAS, the City of Batesville, Arkansas, is respon- sible to provide sufficient treatment for all waste waters being released from the City of Batesville Waste Water Treatment Plant into a natural stream; and WHEREAS, the City Council of the City of Batesville, Arkansas, deems it necessary to cooperate with the County of Independence, the State of Arkansas, and the Federal Government in the control of pollution in our natural streams and rivers for the safety and welfare of all citizens; and further deems it necessary to establish maximum limits to be considered as normal quantities of suspended solids and BOD which may be discharged into the City's sewer system; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Batesville, Arkansas, in regular session assembled as follows: Section: 1. Article III, Private Sewage Disposal, Section 4 of Ordinance 717 of City of Batesville, Arkansas, is amended to read as follows: The type, capacities, location, and layout of a private sewage disposal system shall comply with all recommendations of the Department of Public Health of the State of Arkansas. The following lot sizes should be provided, but are not mandatory, when septic tank absorption field systems are proposed: a. If an individual water well supply and septic tank system are proposed, the lot size should be -1- TM a minimum of 60,.00.0 square feet. The width of the lot should be at least 200 feet; b. If a public water supply is proposed and an individual septic tank absorption field system is to be used for sewage disposal, the lot size should be a minimum of 40,000 square feet and the width of the lot should be at least one-third (1/3) the depth of the lot. The lot width and size requirements may be varied in areas where percolation rates and sub -surface conditions permit and approval of the Arkansas State Department of Health is obtained. In those instances where lots have been platted and recorded prior to the adoption of this ordinance, the lot sizes will not apply. No septic tank or cesspool shall be permitted to discharge to any natural outlet. Section: 2. Article V, Use of Public Sewers, Section 3(b), of Ordinance 717 of City of Batesville, Arkansas, shall be amended to read as follows: b. Any waters or wastes containing toxic or poisonous solids, liquids, or gases in sufficient quantity, either singly or by interaction with other wastes, to injure or interfere with any sewer treatment process, or any part of the sewer treat- ment facilities or sanitary sewerage works, or create any hazard in the receiving waters of the sewage treatment plant, including but not limited to cyanides in excess of 0.003 as CN in the wastes as discharged to the public sewer. Section: 3. Article V. Use of Public Sewers, Section 3(c), of Ordinance 717 of City of Batesville, Arkansas, shall be amended to read as follows: C. Any waters or wastes having a pH lower than 6.0 or having any other corrosive property capable of causing damage or hazard to structures, sewers, equipment or appurtenances thereto or to personnel of the sewage works. Sec tion: 4. Article V, Use of Public Sewers, Section 3(d�, of Ordinance 717 of City of Batesville, Arkansas, shall be amended to read as follows: d. Solid or viscous substances in quantities or of such ,size capable of causing obstruction to the flow in seivers or pumping facilities, or other inter- ference with the proper operation of the sewage works such as, but not limited to ashes, cinders, sand, mud, straw, shavings, metal, glass, rags, reathers, tar, plastics, wood, unground garbage, whole blood, pauch manure, hair and fleshings, entrails and paper dishes, cups, milk containers, etc. either whole or ground by garbage grinders. -2- a cm Section: 5• Article V, Use of Public Sewers, Section 4(h), of Ordinance 717 of City of Batesville, Arkansas, shall be amended to read as follows: h. Any waters or wastes having a pH in excess of 8.0. Section: 6. T'. -.e maximum permissible limits for the following described metals are hereby established. Chromium Zinc Copper Nickel Lead Cadmium Total Metals 0.05 ppm as trivalent 0.01 ppm 0.02 ppm 0.08 'ppm 0.10 ppm 0.01 ppm 0.50 ppm If at least a tenfold dilution is available in a receiving sewer I�system at its absolute minimtm flow or in a receiving stream at its absolute minimum flow, these allowable a le values may be Increased tenfold but no more. Under no circumstances will more than X0.05 ppm CN be discharged to a sewer or stream. If discharge to a sewer or stream is contemplated on any of the metals described below, reference should be made to the Arkansas Polution Control Commission for guidance. Said metals are: Antimony Mercury Arsenic Molybdenum Barium Rhenium Beryllium Selenium Bismuth Silver Boron Strontium Chromium (Hexa) Tellurium Cobal" Tin Iron Uranylion Manganese Concentrations shall not exceed the following: 5 -Day Biochemical Oxygen Demand 285 ppm Suspended Solids 285 ppm Sulphate (SO4) 3.0 ppm Section: 7. Except as Ordinance No. 717 is amended by provi- sions set forth above, all provisions of Ordinance 717 remain lin full force and effect. �.Section: 8. The invalidity of any section, clause, sentence, or provision of this ordinance shall not affect the validity of any other part of this ordinance which can be given effect with- out such invalid part or parts. -3- �I i Section: 9.
