HomeMy WebLinkAbout827BEFORE THE CITY COUNCIL OF BATESVILLE, ARKANSAS ORDINANCE NO. � Z 7 AN ORDINANCE PROHIBITING THE USE OF CRAWLER TRACTORS, TRACTORS WITH LUGS, SPIKES AND OTHER DAMAGING TRACK AND TIRE CONFIGURATIONS EXCEPT WITH A WRITTEN PERMIT, PROVIDING FOR THE ISSUANCE OF A PERMIT, PROVIDING PENALTIES FOR VIOLATIONS, PROVIDING FOR EXCEPTIONS, DECLARING AN EMERGENCY AND OTHER PURPOSES WHEREAS, it has been determined that certain crawler tractors, tractors with lugs, spikes and other damaging track and tire configurations have been used upon the streets of Batesville and WHEREAS, the City Council has determined that the use of such tractors and machinery is damaging to the city streets of Batesville. NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS, AS FOLLOWS 1. From and after the passage of this ordinance it shall be unlawful for any person, corporation or other enity to drive or permit to be driven upon the streets of Batesville any crawler tractor, tractor with lug, spikes and other track and tire configurations which damage the streets. No use shall be made of any such machine in any manner that permits the treads, lugs or spikes of said machine, crawler tractor or tractor to come in contact with the streets unless a written permit has been secured from the Mayor of the City of Batesville. The Mayor shall issue such permit upon the following conditions being met: (a) satisfactory assurances and arrangements made to insure no damage will occur to the streets (b) a bond in a sufficient sum is posted to insure repair of any possible damage. The bond shall be of a type, of an amount and in a form approved by the mayor. 2. No permit shall be required of any such machine actually used in reconstruction of a street in the immediate vicinity of where the reconstruction of the street is taking place. 3. A violation of this ordinance is declared to be a misdemeanor and punishable by a fine of $25.00 to $500.00 and by imprisonment in the county jail from one to thirty days or any combination of fine and jail sentence. Each occurrance shall constitute a separate offense. LJ,The City Council finds and determines that the streets of Batesville are in danger of being damaged by the use of crawler tractors, tractors with lugs and other damaging track and tire configurations and that in order to preserve the surfact of the street and the road bed thereunder an emergency is found to exist and this ordinance being necessary for the preservation of the public health, safety and welfare, said ordinance shall be in full force and effect from and after passage.
