HomeMy WebLinkAbout2011-02-01 ORDINANCE NO.C�O • AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR OTHER PURPOSES. WHEREAS, the Batesville Housing Authority has secured funding for a multi-family housing facility to be located on Woodmont Circle;and, WHEREAS, said funding is predicated on the facility being properly zoned for such purpose; and, WHEREAS,only a portion of the property on which the facility is to be constructed is currently zoned in a manner to permit this use; and, WHEREAS,the Batesville Planning Commission has determined,after a public hearing on January 24, 2011,that the Batesville Comprehensive Plan should be amended to support high density residential development in this area; and, WHEREAS,the Batesville Planning Commission,after conducting a public hearing on February 7,2011,has voted to recommend that said property be rezoned from Commercial Community[C-1] to General Family Residential [R-2]. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS HEREBY AMENDED TO DESIGNATE THE FOLLOWING DESCRIBED PROPERTY AS GENERAL FAMILY RESIDENTIAL [R-2]: • A tract of land being part of the Southwest Quarter, Southwest Quarter of Section 14, Township 13 North, Range 6 West, in the City of Batesville, Independence County,Arkansas,more particularly described as follows: Commencing at the southwest comer of said Section 14,thence S 88 degrees 12 minutes 01 seconds East 331.96 feet to the east right-of-way line of Eagle Mountain Boulevard; thence North 04 degrees 37 minutes 19 seconds East along said east right-of-way line 457.32 feet to the south right-of-way line of Woodmont Circle;thence along said south right-of-way line along a curve to the right. Said curve having a radius of 647.22 feet, an arc distance of 216.90 feet, a long chord bearing and distance of South 76 degrees 24 minutes 03 seconds East 215.89 feet to the point of beginning;thence continue along said south right-of-way line along said curve to the right,said curve having a radius of 647.22 feet,an arc distance 48.85 feet; a long chord bearing and distance of South 64 degrees 38 minutes 16 seconds East 48.84 feet; thence South 62 degrees 18 minutes 31 seconds East 127.33 feet;thence along a curve to the left, said curve having a radius of 476.72 feet,an arc distance of 193.00 feet,a long chord bearing and distance of South 73 degrees 54 minutes 22 seconds East, 191.68 feet to the centerline of an existing sanitary sewer easement;thence leaving said right-of-way line along said sewer easement South 34 degrees 09 minutes 55 seconds West 343.54 feet;thence North 04 degrees 37 minutes 19 seconds East 120.00 feet; thence North 88 degrees 12 minutes 01 seconds West 72.00 feet;thence North 24 degrees 24 minutes 13 seconds West 129.69 feet;thence North 88 degrees 12 minutes 01 seconds West 46.50 feet;thence North 04 degrees 37 minutes 19 seconds East 176.62 feet to the point of beginning; containing 1.47 acres,more or less. IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD • TO BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR PORTIONS OF THIS ORDINANCE. EMERGENCY CLAUSE: Where as it is necessary to effect the public peace,health, safety and welfare and the orderly administration of Batesville City Codes,and whereas it is necessary that this ordinance take immediate effect to avoid irreparable economic harm because the present zoning of this tract is in contradiction with its immediately planned future use,an emergency is hereby declared to exist and this Ordinance shall be effective from and its passage an emergency is hereby declared to exist and this Ordinance shall be effective from and its passage.
