ORDINANCE NO.
AN ORDINANCE TO PROVIDE FOR ThE EJECTMENT OF PERSONS FROM
PLACES OF BUSINESS AND OTKER PLACES WHO CREATE A DISTURBANCE
PROVIDING FOR PU14ISHMENT A14D OTHER PURPOSES.
Be It Ordained by the City Council of Batesville, Arkansas,
as follows:
1. From and after passage of this ordinance owners,
managers, or their designated employees shall have the right to
request any person to leave the place of business or other
premises (w',iere such owner, manager or designated employee works)
when such person is creating a disturbance so that other persons,
patrons, or business invitees are distracted or disturbed.
2. If the person does not leave on request the
owner, manager or their designated employees shall have the
right to physically eject and remove such person from the
place of business or other premises.
3. Types of conduct which shall be prima facie to
have created a disturbance by a person are:
(a) Drunkenness
(b) The throwing of objects at other persons
or if within the confines of a building the
throwing of objects regardless of aim.
Excessive loud talk
Disturbing movements
The use of oaths,
or fighting words.
Obscene gestures.
profanity, vulgarity
4. .A person who has created a disturbance shall be
guiity of a misuemeanor anti punishes: as set out in this ordinance.
A person who has created a disturbance and who has been requested
to leave and who refuses to leave shall Le guilty of a -md sdemeanor
and punished as set out in this ordinance.
5. A person violating the provisions of this
ordinance may be fined from $5.00 to $500.00 and imprisoned
in jail frOLI 1 to 10 days or any combination of fine and
jail sentence.
