HomeMy WebLinkAbout787ORDINANCE NO. ORDINANCE TO CHANGE THE ZONING CLASSIFICATION OF CERTAIN LANDS OWNED BY INDEPENDENCE CENTER, INC. WHEREAS, The City Planning Commission of the City of i Batesville, Arkansas, pursuant to law, has filed its recommendations with the City Council recommending that the following acorn be made with reference to the change in zoning classification of the property hereinafter described, which property is located on Porter Street in Batesville, Arkansas, and is legally described as follows: A part of the Northwest Quarter of the Northeast Quarter of Section 16, Township 13 North, Range 6 West, particularly described thus: Beginning at the intersection of St. Louis and Porter Streets, on the east side of St. Louis Street and the north side of Porter Street, at a rock for a corner, thence east along the north line of Porter Street 210 feet to the point of beginning, thence north 150 feet; thence east 70 feet; thence south 150 feet to the north line of Porter Street; thence west 70 feet along the north line of Porter Street to the point of beginning. AND, WHEREAS, The Batesville City Planning Commission has, after a public hearing with notice thereof published as re- quired by law, recommended that the above described property be i changed from a "R-2" residential classification to a "C -1-A" commercial classification on the grounds that such change in zon- ing classification would be in the best interest of the City of Batesville, Arkansas. NOW, THEREFORE, Be it ordained and enacted by the City Council of the City of Batesville, Arkansas: SECTION 1: That the zoning classification of the property hereinabove described be and the same hereby is changed from an "R-2" residential classification to a "C -1-A" commerical classifi cation. SECTION 2: That the City Clerk shall cause the official] zoning map of tip City of Batesville, Arkansas, to note the change affected herby. SECTION 3: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Approved this da of Y .rcc cid—' 1970. R. W. Gentlemen: Please be advised that Independence Center, Inc., the owner of the property hereinafter described, has petitioned the Batesville City Planning Commission for changing zoning classification of such property from "R-2" residential to "C -1-A" commercial. The property sought to be rezoned is located on Porter Street in Batesville, Arkansas, and is particularly described as follows: A part of the Northwest Quarter of the Northeast Quarter of Section 16, Township 13 North, Range 6 West, particularly described thus: Beginning at the intersection of St. Louis and Porter Streets, on the east side of St. Louis Street and the north side of Porter Street, at a rock for a corner, thence east along the north line of Porter Street 210 feet to the point of beginning, thence north 150 feet; thence east 70 feet; thence south 150 feet to the north line of Porter Street; thence west 70 feet along the north line of Porter Street to the point of beginning. This petition was set for public hearing be- fore the City Planning Commission on August 4, 1970, and notice of such public hearing was duly published as required by law. At the conclusion of the public hearing, a duly constituted quorum of the Batesville City Planning Commission voted to recommend to the City Council that the change in zoning classification of the above des- cribed property requested by petitioner would be in the best interest of the city and should be granted.
