HomeMy WebLinkAbout791ORDINANCE NO. ° AN ORDINANCE CONDEMNING CERTAIN LAND WITHIN THE PROPOSED RIGHT-OF-WAY FOR THE RECONSTRUCTION AND IMPROVING OF ST. LOUIS STREET INCLUDING WITHOUT LIMITATION STORM DRAINAGE FACILITIES; DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PRO- CEEDINGS; AND FOR OTHER PURPOSES AND DECLARING AN EMERGENCY r NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF BATESVILLE, ARKANSAS. SECTION 1: The City of Batesville, Arkansas does hereby condemn for street right -of --way and related drainage facilities the following real property situated in the City of Batesville, Independence County, Arkansas, to -wit: All land situated on, adjacent to, and by, St. Louis Street and on both sides thereof that lies with the proposed right-of-way of the St. Louis Street Highway project known as Job 55&4. Copies of the plans ,-r- �rz_s ,)C_(' are on file in the Arkansas State Highway District Engineer's office, Newport Route, Batesville Arkansas 1 The aforesaid parcel of real property is needed to be utilized as right-of-way in the construction and reconstriAction, of St. Louis Street in the City of Batesville and to provide for necessary storm drainage related thereto. SECTION 2: The City Attorney is hereby authorized and directed to file in the proper court proceedings for the con- demnation of the property described in Section 1 hereof, and to secure an order of such court permitting the City to take immediat possession of said property upon posting a bond in an amount to be determined by the court and to do any and all other things neces- sary in order to obtain immediate possession of said property. THIRD STREET BATESVILLE, ARK. 72501 M SECTION 3: St. Louis Street in its present con- dition is inadequate to accomodate the flow of vehicular traffic utilizing and attempting to utilize said street, thereby causing congestion of traffic thereon and on streets adjacent thereto; and the proposed improvement of said street is designed to relieve the congestion of traffic thereby enhancing the health, peace and safety of the citizens of the City of Batesville, Arkansas. Now, therefore, an emergency exists and this Ordinance being necessary to protect the health, peace and safety shall become effective immediately upon its passage.
