ORDINANCE NO.
AN ORDINANCE REQUIRING A DEPOSIT FOR SEWER AND GARBAGE, PRO-
VIDING EXCEPTIONS DECLARING AN EMERGENCY AND OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS, AS
FOLLOWS:
1) DEPOSIT REQUIRED - From and after the passage of
this ordinance a deposit of $10.00 shall be required for sewer
and garbage service. The deposit will draw no interest. The
deposit shall be made to that agency in charge of collecting
the sewer tax and garbage fees.
2) DEPOSIT REFUND - At anytime should the person in
whose name the deposit is, ask for a refund of the deposit, the
city agency in charge of collecting the sewer tax and garbage
fee shall compute the person's sewer and garbage bill and refund
the difference between the deposit and the garbage and sewer bill
if any.
3) NO CITY UTILITIES CONNECTED - No city water service
shall be connected or turned on at any location until the $10.00
deposit has been made as required by this ordinance.
4) GRANDFATHER CLAUSE - No person or business entity
presently using the city sewer shall be required to make a deposit
so long as they remain at the same address. If such person or
business entity moves and acquires a new address, a deposit as
required by this ordinance shall be made.
5) EMERGENCY - Because the city is losing sewer and
garbage revenue because persons are moving without paying their
garbage fee and sewer tax an emergency is hereby declared and
this ordinance shall be in full force and effect from and after
its passage.
