ORDINANCE WITH REFERENCE TO REZONING PROPERTY OWNED BY JIM DAVIDSON WHEREAS, The City Planning Commission of the City of Batesville, Arkansas, pursuant to law has filed its recommendations with the City Council recommending that the following action be made with reference to the proposed reclassification of the property involved herein, that the following described tracts of property owned by Jim Davidson, d/b/a Davco Electronics, to -wit: Tract 1: Commencing at the quarter section corner to Sections 15 and 16, Township 13 North, Range 6 West, thence South 35 feet along the line between said sections to the South right of way line of State Highway 69, then East along the South right of way line of said highway a distance of 730 feet to the point of beginning; thence South a distance of 164 feet; thence West a distance of 140 feet; thence North a distance of 164 feet to the South right of way line of Highway 69; thence East along said line a distance of 140 feet to the point of beginning. Tract 2: Beginning at the quarter section corner to Sections 15 and 16, Township 13 North, Range 6 West, thence South 35 feet along the line between said sections to the South line of State Highway 69, thence East along the South right of way line of said highway a distance of 450 feet; thence South a distance of 150 feet to the point of beginning; thence East a distance of 140 feet; thence South a distance of 150 feet; thence West a distance of 140 feet; thence North a distance of 150 feet to the point of beginning. that Tract 1 be classified as commercial zoning district C-2; that Tract 2 be classified as commercial zoning district C-2; and that said proposed change would be to the best interest of the City of Batesville; NOW, THEREFORE, Be it ordained by the City Council of Batesville, Arkansas: Section 1: That the City Council adopt the report and recommendation of the City Planning Commission as above set forth and that the land as above herein des- cribed be and is hereby classified under the applicable zoning law and regulation to the chssification of commercial zoning district C-2. Section 2: That the City Clerk shall cause the official zoning map to note the changes above set forth. Section 3: That there is hereby found and declared to be an immediate need for the reclassification as above set forth for the benefit of the public, safety and welfare of the City of Batesville, Arkansas, and particularly the area affected hereby. NOW, THEREFORE, It is declared that an emergency exists and that the ordinance is necessary for the immediate preservation of the public health, safety and welfare and shall be in force and take effect immediately upon and after its passage.
