An Ordinance condemning certain land within
the proposed right of way for the construction of an overpass
within the city of Batesville including without limiting the
necessary approaches, storm drainage facilities, directing
the city attorney to institute condemnation proceedings, for
other purposes and declaring an emergency.
Be It Ordained ay the City Council of Batesville,
Arkansas as follows:
SECTION 1: The City of Batesville, Arkansas
does hereby condemn for street right of way, bridge construc-
tion, drainage facilities and other necessary items the follow-
ing real property in the City of Batesville, Arkansas to -wit:
All land situated on, adjacent to, by, and between
Broad Street starting at the intersection of Main
Street and Broad Street and proceeding Northerly
along an extension of Broad Street to Bayou Street
where Bayou Street intersects Charles Street,
said land being more particularly described as
F.A.P. NO. T. G. - 8020(3) Job 5622. Copies of
the plans and proposed right of way are on file
in the Arkansas State Highway District Engineer's
Office, Newport Route, Batesville, Arkansas and
the Mayor's Office, City Hall, Batesville, Arkansas.
The aforesaid parcel of real property is needed to
be utilized as right of way, drainage facilities and related

matters in the construction of an overpass and bridge in the
City of Batesville.
SECTION 2: The City Attorney is hereby authorized
and directed to file in the proper court proceedings for the
condemnation of the property described in Section 1 hereof,
and to secure an order of such court permitting the City to
take irimediate possession of said property upon posting a bond
in an amount to be determined by the court and to do any and
all other things necessary in order to obtain immediate pos-
session of said property.
SECTIOPd 3: Because of congested traffic conditions
across Poke Bayou and because of the unsafe condition crossing
the rgissouri Pacific Railroad tracks an emergency is hereby
declared and this ordinance shall be in full force and effect
from its passage.
