HomeMy WebLinkAbout780ORDINANCE NO._ AN ORDINANCE ZONING THE HEREINAFTER DESCRIBED PROPERTY SITUATED IN THE CITY OF BATESVILLE ARKANSAS Whereas, the City Planning Commission of the City of Batesville, Arkansas, pursuant to law, has filed its report and recommendation with the City Council recommending that the hereinafter described property owned by J. K. Southerland and Cleo Southerland be designated and given the Zoning Classification of Industrial "I-211, said property being described as follows: That part of the Southeast Quarter of the Southwest Quarter of Section 16, and the Northeast Quarter of the Northwest Quarter of Section 21, in Township 13 North, Range 6 West, described thus: Beginning at the point of intersection of the North Bank of White River and the West line of State Highway No. 11 (now Hwy. 167); thence North along the West line of said Highway 167 to a point 300 feet South of the right-of-way of the Missouri Pacific Rail- road Company; thence in a Westerly direction and parallel to and 300 feet distance from said South line of said right-of-way to the East line of the road which runs from the East end of the Batesville Compress Company's property to the White River Stadium; thence in a Southerly and Southwesterly direction along the East line of said road to a point of intersection of the East line of said road and the East boundary line of the tract of land conveyed by Charles W. Barnett and wife to the Young Men's Business Associa- tion, of Batesville, Arkansas, under date of February 132 1940, by deed recorded in Deed Record Book "R-5", page 202, of the records of said county; thence in a Southerly direction along said East boundary line of said tract of land to White River; thence down and along the North Bank of White River to point of beginning; all lying North of White River and West of Arkansas State Highway No.11 (now Highway 167) and containing 30 acres, more or less, subject to any rights held by the public for roads. That said proposed Zoning Classification would be in the best interest of the City of Batesville; Now Therefore, Be it Hrdained by the City Council of the City of Batesvillep Arkansas: Section 1. That the City Council adopt the report and recommendation of the City Planning Commission as above set forth and that the lands hereinabove described be and are hereby designated and given the Zoning Classification of Industrial "I-2". Section 2. That the City Clerk is directed and shall cause said Classification to be so entered and designated on the Official Zoning Map of the City. Section 3. That there is hereby found and declared to be an immediate need for the Classification as above set forth for the benefit of the public health, safety and welfare of the City of Batesville, Arkansas, and the area affected thereby. It is therefore declared that an emergency exists and that this ordinance is necessary for the immediate preservation of the public hal.th, peace, safety and welfare and shall be in force and take effect immediately upon and,_Ifter its passage. Southerland Gentlemen: Please be advised that J. K. Southerland and Cleo Southerland, owners of certain property recently annexed to the City of Batesville, have petition the City Planning Commission for a recom- mended zoning classification of that property. We are attaching hereto a copy of this petition which particularly describes the property involved. Notice of the filing of this petition and the hearing thereon was duly published as required by law, and proof of publication has been filed with the Planning Commission. Pursuant to such notice, a hearing was held on the 3rd day of March, 1970, before the Planning Commission at the con- clusion of which it was the unanimous recommendation of the Planning Commission that the lands particularly described in the attached petition be given and industrial "I-2" zoning classification.
