Sheleyj T. !�. Biggs er Delcie 0 Biggs et al, Dean SH. Lindsey & Claire F. Lindsey, Batesville School District #l, Rupert C. Brom & Winnie 1 . Brown, Nellie Turner, 'Vlhite River Investors, Inc., - - - - - - - - =-, and described as follows: .h part of the Northwest .Iluartor of the 1."ortheast wuarter of Section 16, Township 13 North, Range 6 'vq'est, in the City of Batesville, Arkansas, described thus: Beginning at the intersection of 3t. Louis and Porter Streets, on the E,-.,.st side of St. Louis Street and the North side of Porter Street; thence 111orth 44.0 feet along the East line of St. Louis 131treet to the Northwest corner of the Sheley property; thenc4 East along the North line of said Sheley property which is the .:youth line of an unnamed street which runs from St. Louis Street to �,_nd Hlong the South side of "Daffin lz� Field" (said street at t-uries beinlg' designa.ted as both Boswell Street and Carter Street) a distance of 350 feet, more or less, to the East line of the Nel'lie Turner property; thence continuing East 83 feet; thence South 2422-3 feet; thence West 33 f. -:et; thence South 30 feet; thence I'lest 50 feet; thence South to a point on the North line of Porter Street, said point being the Southerst corner of the Brown property; thence. Ilest along the Yorth line of Porter Street 70 feet; thence worth 150 feet; thence ti -lest 70 feet; thence South 150 feet; thence 'Nest along Vie North line of Porter Street 210 feet to the point of beginning; th;t same be re-classified as "C -1A11 Corj,.,erciial Zone; and that said proposed change would be to the best interest of the City of Butes ville; 11&V) THEME ORE, Be it Ordained by the City Council of the City of Batesville., j�rkansas: Section 1, That the City Council adopt the report and recommendation of the City Planning Commission as above set forth and that the lands hereinabove described C, be and are hereby classified under the applicable zoning lav and regulations to the I classification of "C-10 Commercial Zone. Section 2. That the City Clerk shall cause the official zoning map to note the change as above set forth. Section 3. That there is herebY found and declared to be an immediate need for the re-classification as above set forth f6r the benefit of the public health, safety and welfare of the City of Batesville, Arkansas, and the area affected hereby. It is therefore declared that an emergency exists and that this ordinance is necessary for the ixm!iediate preseevation of the public health, peace, safett and welfare and Iva- shall be in force and shall take effect imned iately upon and after its passage.
