AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND
AUTHORIZE THE PURCHASE OF AUTOMATIC METER READ METERS
FOR THE BATESVILLE UTILITY DEPARTMENT
WHEREAS, the Batesville Utility Department purchased approximately 300
Automatic Read Meters from Badger AMR in 2010 to begin the implementation of
Automatic Read Meters throughout the utility system; and
WHEREAS, the Batesville Utility Department is trained to use this product and is
currently using this product, and selection of another Automatic Read Meter vendor
would increase expenses for new hardware, software, and training; and
WHEREAS, the Batesville Utility Department has the capability to purchase
Automatic Read Meters from Badger AMR at the 2010 quote until June 7, 2011.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
BATESVILLE, ARKANSAS:
Section 1. That the Batesville Utility Department needs to purchase Automatic
Read Meters and this purchase is budgeted in the 2011 budget.
Section 2. That said meters are to be purchased from Badger Meter Mfg. for the
approximate sum of $350,000.00, more or less.
Section 3. That the City Council in accordance with the terms of A.C.A. Section
14-58-303 hereby waives the requirement of competitive bidding and directs the
Purchasing Officer to purchase the above described utility billing program for the price
set forth in Section 2 above.
Section 4. EMERGENCY CLAUSE: It is further found that due to the immediate
need to acquire the above utility program, an emergency is declared to exist and this
ordinance being necessary for the preservation of the public peace, health and safety
shall take effect from and after its passage and approval.
