CITY ORDINANCE NO._1
ORDINANCE WITH REFERENCE TO THE RE -ZONING OF THF' PROPERTY OWNED
BY NEILL MATT:HEWS AND OPAL MATTHEWS
WHEREAS, the City Planning Commission of the City of
Batesville, Arkansas, pursuant to law, has filed its recommend-
ations with the City Council recommending that the following
action be taken with reference to the proposed re-classification
of the property involved herein: That the following described
property owned by Neill Matthews and Opal Matthews, his wife,
namely -
A part of Lots 13 and 14 of Block 44
of Maxfield's Third Eastern Addition to
the City of Batesville, Arkansas, being
a tract of land 100 feet square in the
Southwest corner of said Block 44, des-
cribed as beginning at the Southwest
corner of Lot 14 of said Block 44; thence
along Harrison Street easterly 100 feet
to the Southeast corner of Lot 13; thence
north along the line dividing Lots 12 and
13, 100 feet; thence west 100 feet and in
a line parallel with Harrison Street to
21st Street; thence south 100 feet to the
point of beginning.

be to the best interest to the City of Batesville; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE)
ARKANSAS:
SECTION 1. That the City Council adopts a report and
recommendation of the City Planning Commission as above set forth
and that the lands hereinabove described be and are hereby re-
classified under the applicable zoning law and regulations to the
classification of "commercial" property,
SECTION 2; That the City Clerk shall cause the official.
zoning map to note the changes as above set forth.
SECTION 3. That the property although now zoned as
"comm-nercial" be restricted to the use of a service station, de-
signed and to be used primarily for the use and sale of gasoline
and petroleum products.

SECTION 4. That there is hereby found and declared to
be an immediate need for the re-classification above set forth for
the benefit of the public health, safety and welfare of the City
of Batesville, Arkansas, and particularly the area affected
hereby; now, therefore, it is declared that an emergency exist
and this ordinance be necessary for the immediate preservatioa of
the public health, safety and welfare shall be in force and shall
take affect immediately upon and after its passage.
