ORDINANCE WITH REFERENCE TO THE RE -ZONING OF THE PROPERTY
OWNED BY M. F. HIGHSMITH AND KATHLEEN C. HIGHSMITH, HIS WIFE
WHEREAS, the City Planning Commission of the City of
Batesville, Arkansas, pursuant to law, has filed its recommenda-
tions with the City Council recommending that the following acti
be taken with reference to the proposed re-classification of the
property involved herein: That the following described property
owned by M. F. Highsmith and Kathleen C. Highsmith, his wife,
namely -
A part of Block 24, Old Town Addition, and Block 11,
School Addition to the City of Batesville, Arkansas,
and a part of the East Half (E2) of the Northeast
Quarter (NE4) of Section 17, Township 13 North, Range
6 West, described thus: Beginning at the North line of
Water Street and the West line of Sixth Street, thence
South 54 degrees West along the North line of Water
Street 104 feet to the East line of the Luther Pickens
lot; thence North 36 degrees West along said line 160
feet to and including a stone wall; thence North 54
degrees East and with said wall 34 feet; thence North
36 degrees West 58 feet to a hedge; thence North 50
degrees East and with said hedge 70 feet to the North-
west line of Sixth Street; thence South 36 degrees with
said line 225 feet to the point of beginning.
be classified as "Commercial" and that said proposed change would
be to the best interest to the City of Batesville; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS:
SECTION 1. That the City Council adopts a report and
recommendation of the City Planning Commission as above set forth
and that the lands hereinabove described be and are hereby re-
classified under the applicable zoning law and regulations to the
classification of "Commercial" property.
SECTION 2. That the City C'.erk shall cause the official
zoning map to note the changes as above set forth.
SECTION 3. That the property although now zoned as
"Commercial" be restricted to the use of office building.
SECTION 4. That there is hereby found and declared to x
an immediate need for the re-classification above set forth for
the benefit of the public health, safety and welfare of the City
of Batesville, Arkansas, and particularly the area affected hereby
now, therefore, it is declared that an emergency exists and this
ordinance be necessary for the immediate preservation of this
public health, safety and welfare shall be in force and shall take
affect immediately upon and after its passage.
