ORDINANCE WITH REFERENCE TO REZONING OF PROPERTY OWNED BY HOWARD

Batesville, Arkansas, pursuant to law, has filed its recommendati ns
With the City Council recommending that the following action be
made with reference to the proposed reclassification
of th e

property involved herein, that the following described property
owned by Howard Tripp, Tommie Tripp, Earl Tripp and Katherine
Tripp, namely:
Tract 1: Part of the East Half of the
Southeast Quarter of Section 17, Township
13 North, Range 6 West, described as follows:
Starting at the intersection of Lawrence and
River Stzets in Batesville, Arkansas, on the
north side of Lawrence Street and the west side
of River Street; thence north along the west
line of :'liver Street 320 feet to the inter-
section of Broad and River Streets; thence
north 36 degrees west and along the west side
of Broad Street 140 feet; thence in a southwest
direction and at right angles with Broad Street
117 feet to place of beginning; thence con-
tinuing in a southwest direction 69 feet and 6
inches; thence north 71 feet; thence in a north-
east direction at right angles with Broad Street
69 feet and 4 inches; thence in a southeast
direction parallel with Broad Street 75 feet
to place of beginning.
Tract 2: Beginning at the intersection of
Lawrence and River Streets on the north side of
Lawrence Street and the West side of 'liver
Stree-. ; thence north along the west line of
River Street 320 feet to the intersection of
Broad Street; thence north 36 degrees west and
along the west side of Broad Street 140 feet
for a starting point; from this starting point
run thence southwesterly at right angles to
Broad Street 117 feet, more or less, to the
west line of the property sold by Mrs. Florence
Kirtley to James F. Wade by deed recorded in
Book X-4, page 158 of the records of deeds of
Independence County, Arkansas; thence north 93
feet, more or less, and thence northeasterly
and at right angles to Broad Street 63 feet,
more or less, to the line of Broad Street;
thence along the west line of Broad Street 75
feet to the starting point of this conveyance
description. (Being located in the unnumbered
Block known as the Old Cotton Yard in the City
of Batesville, Arkansas, and being a part of
the E2 of the SE -14 of Section 17, Township 13
North, Range 6 West.
Tract 3: A part of the Eash Half of the
Southeast Quarter of Section 17, Township
13 North, Range 6 West, described as follows:
Beginning at the intersection of Lawrence
and River Streets on the north side of
Lawrence Street and the west side of River
Street; thence north along the west side of
River Street 320 feet to the intersection
of Broad Street; thence north 36 degrees west
and along the west side of Broad Street 140
feet; thence southwest and at right angles to
Broad Street 186 feet and 6 inches to place
of beginning; thence continue southwest 22
feet to fence; thence north 36 degrees west
and parallel with Broad Street 75 feet to
fence and end of wall; thence northeasterly
and at right angles to Broad Street 74 feet;
thence south 96 feet to place of beginning.
be classified as ''commercial`' and that said proposed change
would be to the best interest of the City of Batesville;
NOW, THEREFORE, Be it ordained by the City Council of
Batesville, Arkansas,
Section 1: That the City Council adopts a report and
recommendation of the City Planning Commission as above set
forth and that the lands hereinabove described be and are hereby
reclassified under the applicable zoning law and regulations to
the classification of "commercial-' property with the use to be
restricted to that of a parking area and the present structure
may be used for warehousing or storage of merchandise, supplies
and equipment.
Section 2: That the City Clerk shall cause the
official zoning map to note the changes as above set forth.
Section 3: That there is hereby found and declared to
be an immediate need for the reclassification above set forth

for the benefit of the public health, safety and welfare of the
City of Batesville, Arkansas, and particularly the area affected
i
hereby.

NOW, THEREFORE, It is declared that an emergency exists)
and that this ordinance be necessary for the immediate preservation
of the public health, safety and welfare and shall be in force
and shall take effect immediately upon and after its passage.
