AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR
OTHER PURPOSES.
WHEREAS, the Batesville Planning Commission,after conducting a public hearing on June 6,
2011, has voted to recommend that certain property be rezoned from Commercial Community [C-1] to
General Family Residential [R-2]; and,
WHEREAS,the Batesville Planning Commission has evaluated said proposed amendment to the
zoning districts map and determined that it is in harmony with the Comprehensive Plan.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE,ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS
HEREBY AMENDED TO DESIGNATE THE FOLLOWING DESCRIBED PROPERTY AS
GENERAL FAMILY RESIDENTIAL [R-21:
A tract of land being a part of the NW '/4 of Section 13,TON, R6W, in the City of Batesville,
Independence County, Arkansas, more particularly described as follows:
Beginning at the southeast corner of said NW '/4;thence N00°50'05"E a distance of 126.10' to the
point of beginning; thence N88°44'10"W a distance of 568.47';thence NO1°03'25"E a distance of
353.62';thence along a curve to the left, said curve having a long chord bearing of N 16°05'36"W and
a long chord distance of 345.00'; thence N56°45'24"E a distance of 65.00'; thence S56°10'11"E a
distance of 318.69';thence along.a curve to the right, said curve having a long chord bearing of
S31'48'O 1"E and a long chord distance of 189.77; thence S88°56'35"E a distance of 244.07' to the
east line of said NW '/4;thence S00°49'58"W a distance of 390.04' to the point of beginning.
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO
BE INVALID,SUCH INVALIDITY SHALL NOT EFFECT THE REMAINING PORTION OR
PORTIONS OF THIS ORDINANCE.
EMERGENCY CLAUSE: Whereas it is necessary to effect the public peace, health, safety and
welfare and the orderly administration of Batesville City Codes, an emergency is hereby declared to exist
and this Ordinance shall be effective from and its passage.
IT IS SO ORDAINED.
