AN ORDINANCE TO ACCEPT MAINTENANCE AND OPERATION OF TRAFFIC CONTRO
DEVICES ON U. S. HIGHWAY 167

WHEREAS, the Arkansas State Highway Commission, by its Job No. 558 ,
will make extensive highway improvements on U. S. 167 in the Bates-
ville area; and

WHEREAS, a part of these improvements will be the installation of
traffic signals at the following intersections:
St. Louis (U.S. 167) - Harrison (S.H. 69)
WHEREAS, the including of traffic signals in the improvements is
subject to the following conditions:
1. Agreement by the City to improve the substandard traffic
control device at the U. S. 69 - Main Street intersection.
2. Agreement by the City to furnish, at no cost to the State,
current to power electrical traffic control signals.
3. Acceptance by the City of responsibility for maintenance
and upkeep of traffic signals at no cost to the State.
4. Agreement by the City to maintain and operate traffic
signals on time cycles provided by the Department.,
NOW, THEREFORE, BE IT ORDAINED by the City Council of Batesville,
Section 1. All traffic signals installed by the Highway Department
under Job No. 5585 shall be maintained and operated by
the City of Batesville, at no cost to the State, on
schedules and time settings provided by the Highway
Department.

Section 2. The signal installation at the State Highway 69 - Main
Street intersection in Batesville has been deemed by
the Highway Department to be substandard and shall be
improved by the City of Batesville in accordance with
recommendations furnished by the Highway Department.
Section 3. This ordinance being necessary for the immediate pres-
ervation of the public peace, welfare, and safety, an
emergency is hereby declared to exist, and this ordi-
nance shall be in force and effect from and after its
passage.
