Section 1, That the business of storing, transporting and/or selling o!f�
spirituous, vinous and/or malt liquors at wholesale within the City of
Batesville, Arka:nsas, is hereby declared to be a privilege; and for the
exercise of such privilege there is hereby levied an annual tax in the
sum of Three Hundred Fifty Dollars for each and every such business
conducted,

sing at retail of any and all vinous, spirituous and/or mit liquors with-
in the City of Batesville, krkanstis is hereby declared to be a privileges,
and for the exercise of such privilege there is hereby levied an annual
privilege tax in the sum of Two Hundred Dollars for each such retail
store operated within said City by any persons firm or corpulation.
Section 3. Any person, firm oz oorporCltion engaging in the busimas

meanor and upon conviction shall to fined in any sum not less than (i
Hundred Dollars and not greater than One Thousand Dollars; and each dal
of such operation without the payment of said license fees shall consti-
tute a separate and distinct offenst.
Section 4. It is hereby declared tc be the intent of said City In order
to avoid confusion to issuc,' such lijenses as are herein provided for in
such a manner that they wilk run for such a length of time as will be
concurrent with the licenses issued by, the State government, It is there-
fore ordained that the City Recorder shall have the right to accept in-
stallment payments of the license fees due the said City for such periods
of time as the State Commissioner of Revenues grants for the payment Of
State license fees.
Section 5. Before any person, firm car corporation shall engage in the
wholesale or retail liquor business In said city, an application shall
be Made to the City Recorder for a permit, Said application shall won-
tain a sworn statement of the name of the business sought to be licensed*
----\\the names and addresses of all of the persons owning or holding any
-'serest in said businessp and the location of said business,, the owner
Or OWB9re of the building or premises in which said store is to\
be
located, and said applicant#s state license shall accompany
application. Then the City Recorder shall issue such license after a'j,
proval by the 01tY Council and upon the Payment of the fees herein pro-
vided and then notify the Town Marshal of the issuance Of Same. Any
person# firm or corporation violating the, provisions of this section
shall be deemed guilty of a misdemeanor and upon conviction fined in any
sum not less than Fifty Dollars nor more than Three Hundred Dollars,
Leption6 , The City Council shall have the right to refuse to grant a
permit to any pereon =z or to any firm or corporation in which a person
or persons own an interest where such person or persons have been conviet-
ed for violation of liquor and/or prohibition laws after Passage of this
ordinance and/or for crimes involving moral turpitude,
Section 7. No persons firra or corporation who shall have Paid a privilege
tax to the county of an amount equal to the fees fixed herein, prior to
the passage and approval of this ordinance for the period from January
lsts 19370 to June 30th, 193?s shall be required to pay the license fee"
herein fixed for that Period of time, but shall be required to comply
with all the other provisions of this ordinance, 4'
Section 8, If any section or portion of a section of this ordinance is
adjudged to be unconstitutional such adjudication shall not affect the
validity and Constitutionality of the remainder of the ordinance,,
Section 9. All ordinances and parts of ordinances in conflict herewith
aremhereby expressly repealed.
Section 10, Whemass the City has been at great expenses in the enforcemett
of the liquor laws and unless some revenue is obtained to pay therefor,

will be highly detrimental to the public peaces health and s�'fety. Therefore
o it
an emergency is declared and this ordinance shall be In full force ztnd ef-
fect from and of its passage and publication.,
