BE IT ORDAINED BY IhL CIN COUXI L OF Wh CITY OF BATESVIU.B, Section 1. Any person, firm. or corporation engaged in the sale of or soliciting the sale of any goods, dares, merchandise or services, either at wholesale or retail, that does not maintain an establish- ed place of business within the City of Batesville, Arkansas, is hereby defined as an itinerant vendor. Section 2. The tem transient merchant as used in this ordinance shall mean any person, firm or corporation engaged temporarily in a retail sale of goods, wares, merchandise or services and who, for the purpose of conducting such business, occupies any lot, building, room or structure of any kind, including railroad ears; provided, that this ordinance shall not be applied so as to re- quire merchants having regularly established places of business within the City of Batesville, ,Arkansas, to obtain licenses for incidental or temporary sales or deliveries direct from railroad oars, and further provided that no person, firm or corporation continuing in the same business in the same municipality for more than six consecutive months, or whose stock of goods and merchan- dise has been assessed for taxation and the taut has been paid, shall be deemed to be a transient merchant, or shall be required to obtain a second license. Section 3. No itinerant vendor or transient merchant shall engage in business in the City of Batesville, Arkansas, 'without first obtaining a ,lioeuse therefor from the Cite Ivoorder as hereinafter provided. Section 4. For each license issued under the provisions of this ordinance, the applicant shall pay the appropriate fee according to the following classification and schedule: TP �L .UZR5 Per week . . • . . . • . . . .
