AN ORDINANCE PROVIDING FOR AND REGULATING AUTOMATIC
TRAFFIC CONTROL SIGNALS, TRAFFIC SIGNS AND MARKINGS,
AND P SCRIBING PEN, LTIES FOR NON COMPLIANCE THEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS:
Section 1. The words "vehicular traffic" wherever appearing in this ordinance

shall be construed to mean the traffic of any kind of vehicle, cycle, animal,iwoom
or instrumentality used for and/or in the transportation of either persons
or property.
Section 2. That whenever and wherever within said City traffic is controlled by
any automatic traffic control signal exhibiting the words "Go", "Caution", or
"Stop", or exhibiting different colored lights successively, said words and
lights shall indicale as follows:
(A) Green alone or "Go".
1. Vehicular traffic facing the signal may proceed straight through
or turn right or left unless a sign at such place prohibits either such
turn. But vehicular traffic shall yield the right-of-way to other vehicles
and to pedestrians lawfully within the intersection at the time such sig-
nal is exhibited.
2. Pedestrians facing the signal may proceed across the street with-
in any marked or unmarked crosswalk.
(B) Yellow or "Caution" wYen shown following the green or "Go" signal.

nearest crosswalk at the intersection, but if such stop cannot be made in
safety a vehicle may be driven cautiously through the intersection.
2. Pedestrians facing such signal are thereby advised that there is in-
sufficient time to cross the street, and any pedestrian then starting to
cross shall yield the right-of-way to all vehicles.
(C) Red alone or "Stop"*
Vehicular m- fic facing the signal shall stop before entering the
nearest crosswalk at an intersection or at such other point as may be indi•
oated by a clearly visible line and shall remain standing untill green or
"Go" is shown alone.
2. Pedestrians shall observe such signals and shall not proceed across
the street until such time as the green or "Go" signal is exhibited. Vehi-
cles may make right turns against red of "Stop" lights from the- proper icwi
lane after coming to a complete stop, provided there is no interference with
traffic having the right-of-way=
and it shall be unlawful for any person to fail to observe the said signals as
herein indicated and defined.
Section 3. It shall likewise be unlawful for the driver of any vehicle and the
rider of any :1n6- t iK cycle or animal to disregard and fail to observe and
comply with any non -automatic STOP sign, Slow sign or other traffic sign or marking
that is placed on, upon, by the side of or over any street of the
City under and by authority of the City Council; and# no person shall place, main-
tsin or display on, upon, byf the side of, over or in view of any street any un-
authorized traffic sign or marking which purports to be or resembles an official
traffic sign or marking.
Section 4. Any person, firm or corporation violating any provision of this

ordinance shall be deemed guilty of a misdemeanor; and upon first conviction
shall be fined in any sum not less than $1.00 aor more than $25.00; for
a second such conviction not less than $5.00 nor more than $50.00; and for a
third or subsequent conviction not less than $10.00 nor more than $100.00, or
by imprisonment for not more than 90 days, or by both such fine and imprisonment.
Section 5. All ordinances and parts of ordinances in conflict herewith are hereby
repealed.
Section 6. It is ascertained and declared that lack of traffic regulation and
observance endangers the life and property of the citizens of Batesville. It is
therefore declared that an emergency exists, that this ordinance is necessary
for the immediate preservation of the public peace, health and safety, and that
this ordinance shall be in Rill force and effect from and after passage and pub-
lication.
