Section 1. The office of Sexton for Oaklewn Cemetery is hereby abolished.
Section 2. The City Council may in its judgment enter into a contract and agreement
vaith any local charitable or benevolent association or organization for the management,
maintenance, supervision and control of said Oaklavan Cemetery; but prior to so contract-
ing, or subsequent to the termination of any such contract if and when made, said Coun-
cil shall employ a Caretaker of and for said Cemetery on a monthly basis at a monthly
salary to be fixed by the Council. Said Caretaker shall devote his full time and en-
ergies to said Cemetery, and such salary shall constitute his entire remuneration for
each, every and all service performed in said Cemetery. It shall be the duty of said
Caretaker to sell lots, to keep and supervise the keeping of proper records thereof,
and to see that proper and accurate muniments of title pass thereto; to dig and super-
vise the digging of graves at the proper location and depth for such charges as may
be fixed by the Council; to solicit and rake contracts with the individual owners of
lots in said Cemetery for any particular work, upkeep or attention thereto, and for the
annual upkeep and r.aintenance thereof, at such schedule of charges as shall be fixed
by the Council; to collect, and receipt therefor, all such sums as may be due for sales
and services as aforesaid, and make clue and prompt ralont}.ly remittances thereof to the
City Treasurer; to file monthly reports with the Council in such detail as may be re-
quired by said Body; to devote his best efforts to the proper care, maintenance, upkeep,
and general supervision of said Cemetery; and to do and perform any and such other spec -
4 fie duties, in and on said premises, as iray be from time to time ordered and directed
by proper Resolution of said Council. Said Caretaker shell enter into good and suf-
ficient bond in such sum as may be fixed by the Council conditioned that he promptly
pay over to said City all sums of money which he shall receive by virtue of his said
employment.
Section_ 3, Sections 35 and 36^ and those portions of Sections 41, 42 and 44 of said
51- relating to compensation for services, are hereby specifically repealed, and
all other ordinances in conflict herewith be and they are hereby generally repealed.
Section. 4. It is ascertained and declared that due to recent and divers and general
developments Oaklavrn Cemetery is sorely in need of care, maintenance and supervision
which if not irmiediately remedied v:rill result, at this season particularly, in a bad
and general unsightly condition and thereby endan er the heylth, s.-afety and well being
of the inhabitants of the City of Batesville. It is therefore declared that an emergency
exists, that this ordinance is necessary for the irmiediate preservation of the public
peace, health and safety, and that this ordinance shall take effect and be in force
from and after its passage and publication.
