AN ORDINANCE TERMINATING, REPEALING, AND DIRECTING
WRITTEN NOTICE OF THE TERKIINATION OF, SECTION TWO OF
ORDINANCE NO, 560 OF THE CITY OF BATESVILLE WHEIE IN
CONTRACT WAS ENTERED INTO WITH THE SOUTHWESTERN BELL
TELEPHONE COMPANY PROVIDING FOR ANNUAL CASH PAYMENT
IN LIEU SOF CERTAIN TAXES, LICENSES, CHARGES AND FEES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS:
Section One. Be and it is hereby the express intention of the City of
Batesville to terminate at the expivation of the current period, to -wit,
on April 1, 1943, its agreement with the Southwestern Bell Telephone
Company to accept annual cash payments "in lieu of all other licenses,
charges, fees or impositions (other than the usual, general, or special
ad valorum taxes) which t now exist or might be imposed by the City
under authority conferred by law"; said agreement having been entered into
under and pursuant to Section Two of Ordinance No. 560 of said City of Bates-
ville enacted on March 12, 1940. To such end, and in conformity with prov-
isions of said Section Two of Ordinance No. 560, the Mayor and City Recorder
of said City are hereby directed to give said Southwestern Bell Telephone
Company the required sixty (60) days written notice of such termination.
Section Two. All express or implied provisions of said Section Two of Ord -
inane No. 560 are hereby repealed; but, nothing herein contained shall be
construed as affecting any existing rights of said Southwestern Bell Tel-
ephone Company to maintain a telephone system within said City.
Section Three. This ordinance shall take effect and be in force from and
after its passage and approval.
