AN ORDINANCE AMENDING ORDINANCE N0, 550 BY MODIFYING
THE PENALTY FOR PERSONS DRIVING A VEHICLE WHILE UNDER
THE INFLU,PTCE OF INTOXICATING LIQUOR OR NARCOTIC DRUGS*
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILIE, ARKANSAS:
Section 1, Section 2 of Ordinance No. 550 of the City of Batesville,
Arkansas, is hereby amended to read as follows:
Every person who is convicted before the Mayor of Af a
violation of Section 1 of said Ordinance shall be punished by imprison-
ment for not:less than 10 days nor more then 1 year in jail, or by a
fine of not less than $25.00 nor more than $1,000.00, or by both fine
and imprisonment. On a second or subsequent conviction he shall be
punished by imprisonment for not less than 30 days nor more than 1 Year
in jail, and, in the discretion of the court, by a fine of not more than
$1,000.00.
Section 2. All ordinances or parts of ordinances in conflict herewith
are hereby repealed, and this ordinance shall be in force and effect
from and after passage and publication.
