Be it enacted by the Council of the City of Batesville, Arkansac, that:
Section 1. Batesville ;'dater Compary, Inc., shall make available to the ;pity
of Batesville, Arkansas, water :service for fire protection through fire hy-
drants located in the streets and alleys of said City and shall furnish water
service through said fire hydrants at the following rates:
63 Fire Hydrants C $2.00 per Month per Hydrant - Total: ";)1.26.00
Section 2. Upon request by the City, the Batesville '�47. Company, Inc., will
cuppl.y additional fire hydrant service for fire protection n,,.irposes in excess
of the number stipulated above, at the rate of '$2.00 per month per hydrant,
provided, however, the annual net income equals six (6) per cent of the cost
of the extension.
Section 3. 711ater Company will supply and Cit;= will take and pay for all water
service required by ✓ity for fire protection purposes in accordance with the
rate set forth herein, but no monthly bill for water eervice shall be less
than X126.00 during the term of this aCreement or any extOnsion hereof. Av
provided for in Section 2, hereof, additional fire hydrants t,.!hich may be in-
stalled at the request of the City shall be billed in accordance with the
rate and upon the conditions stipulated.
Section 4. Nater Company will.. supply and City will take and pay for all other
water service required by the ^it,r in accordance with applicable rate schedules
now on file and as they may in the future be filed and approved by the Depart-
ment of Public Utilities of the State of Arkansas.

Section 5. till bills for t -,rater service hereunder shall be rendered monthly,
are due upon presentation and are payable within ten days from the date there-
of at the Company's office located in Batesville, Arkansas.
Section 6, All other ordinances and agreements and parts of ordinances and
a,r,-ements relating to this charge for water service to said City are hereby
repealed and this constitutes the entire and only agreement between the Water
Company and the City with reference to the s?.abject matter hereof, and supersedes
all previous understandings, either written or oral.
Se on The term of this agreement shall be from 19 to
1949, and shall be automatically extended for successive
.periods of one year each, until terminated by written notice given by one party
to the other not more thur six (6) months nor less than "hree (3) months prior
to the expiration of the original term or ani, anniversary thereof.
Section 8. 'Said , a+er Company shrill have thirty (30) days from and after its
passage and approval to file its written acceptance of this Ordinance with the
City Clerk, and upon such acceptance being filed, this Ordinance shall be con-
sidered as takinT effect and being in force from and after the date of its
passage and approval by the ';'ayor.
