AN ORDINANCE VACATING C,RTAIN STREETS IN EAST END
HEIGHTS ADDITION IN THE PUBLIC INTEREST.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSASs
1. Whereas a petition was duly filed with the City
Council of the City of Batesville, Arkansan, on the 28th day of
January, 1947, asking the City Council to vacate and abandon all
that portion of Twenty-first Street and Twenty-seoond Street
in mast End Heights Addition, between Main Street and College
Avenue, said streets being designated on the plat of East End
Heights Addition to the City of Batesville! Arkansan now appegri.
of record in Deed Record Book tp.,41 at page 534, in the Office
of the Recorder in and. for Independence County, Arkansas, as
Fourth Street and an un -named street east of Fourth Street.
2. Wh reas, after due notices as required by law,
the Council has, at the time and place mentioned in said notice,
heard all persons desiring to be heard on the question and has
ascertained that the streets, or portions thereof hereinbefore
mentioned, have heretofore been dedicated to the public use as
streets herein described; have not been actually used by the
public generally for a period of at least five years subsequent
to the filing of the plat aforesaid; that all the owners of
property abating upon the portion of said streets to be vacated
have filed with the Council their written consent to such abandc
ment; and that the public interest and welfare will not be advex
sely affected by the abandonliment of such streets.
NOW, THEREFORE, Be It Ordained by the City Counctl
of the City of Batesville, Arkansas, as follows$
$action is The City of Batesville, Arkansas, hereby
releases, vacates and abandons all its rights, together with
the rights of the public in general, in and to the streets des-
ignated as follows Twenty-first Street and Twenty-second Streets
between Main Street and College Avenue in East End Heights
Addition to the City of Batesville, Arkansas, and being designate
on the plat of said Addition now of redord in Deed Record Book
'G-41 at page 534 of the Deed Records in and For Independence
Countyq Arkan3ast as Foutth Street and an un -named street east
of said Fourth Street.
Section 2s A copy of this ordinances duly certified,
by the City Recorder shall be filed in the Office of the Records
of Deeds in and for Independence County, Arkansas$ and recorded
in the deed records of said county.
Seetton 3s This Ordinance shall take effect and be
in force from and after its passage.
