AN ORDINANCE ENTITLED: "AN ORDINANCE TO RELCASE, VACATE AND
ABANDON THAT PART OF THIRD STREET (NOW MARK STI' +T) WHICH
LI.ES BETg EiN BLOCK FM AND BLOCK TVTELVE OF ViMOUGH'S ADDITION
TO THE CITY OF BATESVILLE, ARKANSAS."
BE IT ORDAINED BY THE CITY COUNCIL OF TIRE CITY OF BATESVILLE, ARKANSAS:
a'AS, a petition was duly filed with the City Council
of the City of Batesville, Arkansas, on the 27th., day of November,
1951, asking the City Council to vacate and abandon all that portion
of the street designated on the Plat of the W'ycough Addition to said
City now appearing of record in Book S-2 pages 407-409 in the Office
of the Recorder of Independence County at Batesville, Arkansas, as
Third Street (Now known as Mark Street) beginning at Addie Street
and running West between Blocks Five (5) and Twelve (12) of said
Wycough's Addition and being all -that portion of Third Street (Now
known as Mark Street) lying between said Blocks 5 and 12, and being
50 feet in width between said blocks and 103 feet in depth running
West from Addie Street.
WHEREAS, after due notice as required by law, the Council
has, at the time and place mentioned in the Notice, heard all persons
desiring to be heard on the question and has ascertained that the
portion of the Street thereof, hereinbefore described, has heretofore
been dedicated to the Public Use as a Street hereim described, has not
been actually used by the Public generally for a period of at least
five years subsequent to the filing of the Plat; that all the owners
of the property abutting upon the portion of the Street to be vacated
have filed with the Council their written consent to such abandonment;
and that the Public Interest and Welfare will not be adversely affected
by the abandonment of such portion of said street*
NOVI FORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BATESVILLE, ARKANSAS:
Section 1• The City of Batesville, Arkansas, hereby
releases, vacates and abandons all its rights, together with the
rights of the public generally, in and to the Street or portion
thereof, designated as follows;
All that portion of Third Street (Now Mark Street) which
lies between Blocks Five (5) and Twelve (12) and West of Addie
Street as designated on the Plat of the Wycough Addition to the
City of Batesville, Arkansas, now appearing of record in Book
S-2 at pages 407-409 in the Office of the Recorder of Independence
County at Batesville, Arkansas, and being further described as a
parcel of land Fifty (50) feet in width between said Block 5 and
Block 12, and One Hundred Three (103) feet in depth West from Addie
Street, in said Wycough Addition.
Section 2. A copy of this Ordinance duly certified by
the City Clerk of the City of Batesville, Arkansas, shall be filed
in the Office of the Recorder of Independence County, at Batesville,
Arkansas, and recorded in the Deed Records of said County*
Section 3. This Ordinance shall take effect and be in force
from and after its passage.
