<br />Vehereas, there is a great loss and destruction by fire of property loomed 
<br />outside the corporate limits of our city] and 
<br />Whereas, many of these fires endanger property located within the corporate 
<br />limits of our municipality; and 
<br />4b'hereas, there will be mutual benefits and protection for the city and its 
<br />neighboring cities by entering into mutual aid. agreements; and 
<br />brhereas, the General "ssembly of the State of Arkansas has authorized sending 
<br />fire fighting equipment outside imp corporate limits of a city by Act No. 270 of 
<br />1951, and has authorized mutual aid agreements between cities and toms by Act 
<br />23 of 1949; Now, Therefore, 
<br />BE IT OEDAI1M BY THE CITY COUI4CIL OF TLE CITY OF BATESVILLE, AI%KAKSAS: 
<br />Section 1. No fire department apparatus shall be taken beyond the corporate limits 
<br />of the -pity of Batesville, Arkansas, to assist at any fire or for any other pur- 
<br />pose, except by order of the Mayor or Fire Chief, and subject to the restrictions 
<br />and conditions hereinafter set forth. 
<br />Section 2. The Layer or Fire Chief are authorized, in their discretion, to aid 
<br />in the extinguishing of fires in another municipality, public institution, corpo- 
<br />ration, or other properties within a reasonable distance from the City of Bates- 
<br />ville, or on property immediately adjacent to said city in which there is a poss- 
<br />ibility of fire spreading within its corporate limits, under the following 
<br />conditions: 
<br />(a) A request from a city or incorporated town for assistance must come 
<br />only from the kayor, Fire Chief or such other person as may be designated by 
<br />mutual agreement; 
<br />(b) Calls may be responded to only by such apparatus which in the judg- 
<br />irient of the 1ayor or Fire Chief can be safely sent without unduly impairing the 
<br />fire protection within the city, and when highways and weather conditions are 
<br />favorable; 
<br />(c) The city, incorporated town, public institution, corporation, or 
<br />individual requesting assistance must pay the charge for apparatus and service 
<br />hereinafter provided unless there exists a mutual aid agreement; 
<br />(d) The city, incorporated town, public institution, eorporation,or 
<br />individual must compensate the City of Batesville, Arkansas, for any loss or damage 
<br />to such apparatus while answering such call, and be responsible to the members of 
<br />the fire department of the City of Batesville for any injuries suffered or incurred 
<br />by them while responding to such calls and while working at such fire. Duty to 
<br />indemnify or pay shall be performed within 15 days after demand. 
<br />Section 3. Unless there exists a mutual aid agreement, every municipality, public 
<br />institu on, corporation, or individual requesting and receiving such service of 
<br />the fire department of the City of Batesville, Arkansas, shall pay for such service 
<br />and the use of apparatus as follows: 
<br />(a) For each fire driver a sum representing a 1.50 per hour or part there- 
<br />of from time apparatus leaves the fire house until it returns thereto, and as to 
<br />each fireman helping at such fire, a sum representing $ 1.00 per hour or part there- 
<br />of from the time he reports to Fire Chief until he returns and his service end* 
<br />(b) For use of fire fighting apparatus, to -wit, any fire truck . .75.U0. 
<br />Said fees shall be payable to the TvIunicipal Treasurer within 15 days after 
<br />demand.— 
<br />Section 
<br />emand. Section 4. The Layor, City Clerk and Chief of the Fire Department of Batesville 
<br />are hureFy authorized to enter into mutual aid agreements% with other municipalities 
<br />for the rendering of fire fighting services, subject to the following conditions: 
<br />(a) That the municipality with whom such mutual aid agreement is entered 
<br />into shall agree to indemnify the City of Batesville against any and all loss, 
<br />cost and damage which it may suffer or sustain by reason of damage to any appara- 
<br />tus arising from any cause whatsoever while such apparatus is going to or from the 
<br />scene of the fire or while at such scene. Duty to indemnify shall be performed 
<br />within 15 days after demand; 
<br />(b) As to each fire truck driver injured while driving to or from the 
<br />fire, or while at the scene of the fire, and as to each fireman ten route or helping
