HomeMy WebLinkAbout639YAW ORDINANCE NO..�� AN ORDINANCE CREATING THE OFFICE OF PLLIMIM INSPECTOR; GOVERNINu THE CONSTRUCTION, INSTALLATION AND INSPECTION OF PLUMBING; AND OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSASs Section 1. Definitions. Plumbing for the purposes of this ordiance is hereby def ine as follows: a. All piping, fixtures, appliances and appurtenances in connection with the water supply and drainage systems within a building and to a point from three to five feet outside of the building. b. The construction and connection of any drain or waste pipe carrying s6wage from a point within three to five feet outside of the foundation walls of any building with the sewer service lateral or other disposal terminal, including pri- vate domestic sewage treatment and disposal systems and the alteration of any such system, drain or waste pipe, except minor repairs to faucets, valves, pipes, ap- pliances and removing of stoppages. c. The water service piping from a point within three to five feet outside of the foundation walls of any building to the water meter or other water utility property or other terminal and the connecting of domestic hot water tanks, water softeners, and water heaters with the water supply system. d. Water pressure systems other than public utility systems. ee A plumbing and drainage system so designed and vent piping so installed, as to keep the air within the system in free circulation and movement, and to pre- vent with a margin of safety unequal air pressures of such force as might blow, siphon or affect trap seals or retard the dischafge from plumbing fixtures, or permit sewer air to escape into the building. Section 2. State Code. The provisions and regulations of the Arkansas State Plumb- ing CoZe, and amendments thereto, adopted by the State Board of Health of Arkansas are hereby made a part of this ordinance by reference, three certified copies of which shall be on file in the office of the City Clerk, and shall extend over and govern the installation of all plumbing installed, altered or repaired in the City of Batesville, Arkansas. Section 3. Inspection and Supervision. —'" a, There is hereby created the position of Plumbing Inspector who shall be appointed by the Mayor, subject to the confirmation of the City Council. b. The Plumbing Inspectg r shallceive as full compensation for his services as such inspector the sum of#V cAaC(, A-* per month or an amount equal to,W per cent of all plumbing inspettion fees co33ected by the City, whichever is Tess. c. The Plumbing Inspector shall have experience in the business of plumbing to the extent that enables him to know when plumbing is installed in accordance with the provisions of the Code. He shall not be connected wit Vwy person, firm or corporation directly or indirectly engaged in the business of plumbing or plumbing supplies. d. It shall be the duty of the Plumbing Inspector to enforce all provisions of this ordinance and the Plumbing Inspector is hereby granted the authority to enter all buildings in the City of Batesville, in the performance of his duties between the hours of 8sa.m. and 51p.me daily. )Ehe Plumbing Inspector shall issue permits for plumbing work as herein provided and shall prepare suitable forms for applications, permits and other reports. e. It shall be the duty of the Plumbing Inspector to inspect and test all plumbing work for compliance with the Code. Section 4. Applications, Permits. a. Before beginning any plumbing work in the City of Batesville, Arkansas, the person installing same shall apply to the Plumbing Inspector, or other des- ignated official and obtain a permit to do such work. Only those persons author- ised to do plumbing may be issued permits. A permit may be issued to a property owner to install plumbing in a single family residence provided the property owner does the work himself and the building is owned and occupied by such owner as his home. b. Application for permits shall be made on suitable forms provided by the 0 Page #2 Plumbing Inspector. An additional fee of / O® shall be charged for each additional trip on the part of the Plum ing Inspector, caused by the negligence of the Plumber. Section 5. Bond Required• Every Master Plumber doing business in the City of e es e, Arkansas, shall execute and deliver to the City a bond with a surety bonding company in the sum of $1000.00 to indemnify the city or any citizen for any damage caused by the failure of such Master Plumber to comply strictly with the provisions of this ordinance. No plumbing permit shall be issued to any Master Plumber unless this bond has been delivered to the city and is in full force and effect • Section 6, Street Openings. a. All openings made in the public street or alleys to install plumbing must be made as carefully as possible and all materials excavated from the trenches shall be removed or placed where the least inconvenience to the public will be caused. b• All openings must be replaced in precisely the same condition as before the excavation started and all rubbish and material must be removed at once, leaving the street or sidewalks clean and in perfect repair* c• All openings shall be marked with sufficient barriers. Flares or red lamps shall be maintained around the opening at night and all other preeautions shall be taken by the plumber or excbvator to protect the public from damage to person or property. Section 7. Penalties. Any person, firm or corporation found guilty of violating any of T15eyrovisions of this ordinance shall, be subject to a fine of not less than. All ordinances or parts of ordinan. ces conflicting witJX any of the provisions of this ordinance are hereby repealed. Section 9. This ordinance being for the regulation of plumbing and for the pro- ectUonr`of the public, the provisions hereof are declared to be separable, and the invalidity of any clause, sentence, paragraph or section hereof shall not affect the validity of the remainder of this ordinance.
