IN THE COUNM COURT OF INDEPENDENCE COUNTY, ARKANSAS
ORDER
Whereas, the City of Batesville, Independence County, Arkansas,
has passed Ordinance No. 648, which authorizes the cormuittment to
the Independence County jail of prisoners arrested by city law
enforcement officers that would normaly be committed to the City
of Batesville jail, and,
Whereas, the use of the Independence County jail both by the
county and by the city will result in better jail facilities and
management, now therefore, the Court being well and sufficiently
advised in the premises doth find:
That ,the court has jurisdiction of this matter and authority
to make this order.
That the City of Batesville, Independence County, Arkansas, has
passed Ordinance No. 648, a certified copy of which is attached hereto

and made a part hereof as though set out herein, word for word, which
same ordinance as a part of this order is ordered spread upon the
records of the County Court of Independence County, Arkansas; that
under the tems of this ordinance the city shall pay to the County
Sheriff the sun of $1.50 per day for each and every city prisoners
who may be kept, feed or confined in the Independence County jail,
this sum payable monthly on bills rendered on or before the 5th day
of each month.
That the .terms of the ordinance as set out above are fair and
equitable and adequately reimburses the county for confining these
prisoners.
It is therefore, considered, ordered, adjudged and decreed that
the Independence County Jail may be used by the City of Batesville,
Independence County, Arkansas for the keeping of city prisoners;
that the city shall pay to the County Sheriff and/or County Jailor
the sum of $1.50 per day for each and .every city prisoner kept;
that these bills shall be payable monthly on bills rendered to the
city on or before the. -5th day of each month; that the County Sheriff

AN ORDINANCE PROVIDING FOR THE USE OF THE INDEPENDENCE
COUNTY JAIL BY THE CITY OF BATESVILLE IN TBE EXERCISE OF
ITS LAV1 ENFORCEMENT FUNCTIONS; SETTING FORTH THE TERMS AND
PROVISIONS OF SUCH USE; REPEALING ALL ORDINANCES IN CONFLICT;
AND FOR OTEER PURPOSES.
Whereas, under statutes of long standing and use it is both recognised
and provided that a municipality can be allowed and avail itself of the use
of the county jail of the county in which such city is located; and,
Whereas, it is felt that it would be in the best interest of our well
ordered society, law enforcement and the well being of both the City of
Batesville and Independence County, Arkansas, that said City of Batesville
use, exclusively, the facilities of said Independence County Jail in the
exercise of its law enforcement functions; therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS:
Section 1. That hereafter the City of Batesville, Arkansas, shall use the
Independence County, Arkansas, Jail in the usual manner and to the exclusive
extent a jail is needed and utilized by a city in its full and complete law
enforcement functions. For the use of such facilities, and in full satis-
faction thereof, the City shall pay to the County Sheriff and/or the County
Jailer the sum of One and one-half Dollars ($1.50) per day for each and every
City prisoner who may be kept, fed and confined therein, payable monthly.
Bills shall be rendered the City on or before the fifth day of each month
covering itemized charges for the preceding month.
Section 2. All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
Section 3. Such ordinance shall be in full force and effect from and after
s passage and acceptance by appropriate order of the County Court of
Independence County. Upon such acceptance, a duly certified copy of such
ordinance shall be entered at length upon the County Court Records of said
county, and a certified copy of such order of the County Court furnished
the City of Batesville,
