AN ORDINANCE PROVIDING THAT THE CITY CLERK OF BATESVILLE SHALT, BE EX*OFFICIO CLERK OF THE MUNICIPAL COURT OF BATESVILLE, ARKANSAS;PRESCRIBING DUTIES AND FIXING REMUNERATION OF SUCH EX_ OFFICIO CLERK OF SAID MUNICIPAL COURT, AND OTHERWISE IMPLEMENTING THE OPERATION OF SAID COURT; REPEALING ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH; AND FOR OTHER .PURPOSES. BE IT ORDAINED BYY'THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS; Section 1. That the duly elected City Clerk of the City of Batesville, Arkansas, be and such -officer is hereby designated and constituted as Ex -Officio Municipal Court Clerk of the Municipal Court of Batesville, Arkansas, and shall perform all duties incident to -such office. As Ex -Officio Clerk of said Court, said officer shall receive an annual salary of Nine Hundred Dollars, payable exclusively out of the fund and "Account" hereinafter set forth. Such officer as City Clerk and Ex -Officio Municipal Court Clerk shall, for each term of said office, execute and provide a bond, conditioned on due and faithful performance of all the duties of said offices and the proper accounting for all funds that may come into his hands, in the sum of Three Thousand Dollarg, with surety thereon a corporate bonding company duly authorized to do business in the State of Arkansas, and said City shall pay the premium on such bond. Section 2. That like Clerk+s fees shall be allowed and taxed as costs by the Municipal Court of Batesville, Arkansas, as are now provided, or may be hereafter provided, by statutes of the State of Arkansas. All such fees and costs shall be remitted and paid over, on or before the fifth day of each month, by said Clerk to the City Treasurer of Batesville, who shall set up a distinct and separate account in which such funds shall be kept to be de- signated as the "Municipal Court Clerk Salary Fund Account." Settlement shall be made by said Clerk, on or before the fifth day of each month, of all fines coming into his hands, payment to be made to respective governmental units entitled thereto under State statutes in such cases made and provided. Section 3. The salary of such officer as Ex -Officio Clerk Of said Court shall be paid in monthly installments on warrants drawn on the City Treasurer out of said "Municipal Court Clerk Salary Fund Account." If the funds in said "Account" shall be in- sufficient to pay in full the compensation and salary provided by this ordinance then, and in such event, the salary of such officer as Ea -Officio Clerk of said Court shall be reduced ratably and in like proportion to the amount of funds in said "Account." Any surplus funds remaining in said "Account" in excess of the sum of One Hundred Dollars, which is fixed as a cushion, at the end of each fiscal year, shall be paid over and transferred by warrants drawn on the City Treasurer as follows; one-half to the general funds of the City of Batesville, and one-half to the general fund of Independence County, Arkansas. Section 4. Such Ex -Officio Clerk of said Court, as to all matters and procedures not herein specifically set forth, and all other officers serving in any manner said Municipal Court, shall, as to all reports and accountings and all other duties in relation to said Court, be governed by the State statutes in such cases made and provided. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 6. It is ascertained and declared that the failure to pay an adequate salary to the Municipal Court Clerk for the Municipal Court of Batesville, Arkansas, impedes the efficiency Of said Court and endangers the peace and safety of our citizens. It is therefore declared that an emergency exists, that this ordinance is necessary for the immediate preservation of the public Peace, health and safety, and that this ordinance shall take effect and be in force from and after passage. ARKANSAS August 25, 1955 City Council Batesville Arkansas Gentlemen: We hereby petition and recommend to the City Council that an ordinance be passed raising the salary of R. W. Sturch as Municipal Court Clerk from 050 a month to $75 a month with the entire salary to be paid out of fees collected through the Municipal Court. In this way if sufficient fees were not collected to pay the $75 per month the proposed increase would not cost the City or the County anything. On the other hand, if fees were collected, he would be enable to draw this increase and we feel that this increase is well deserved on the basis of the amount of work he does.
