All ORDINANCE CREATING A CITY PLA3lN INC- C OT"3aS S I ON OF
THE CITY OF BATESVILLE, ARKANSAS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BA TESVILIE , ARI hNSAS :
Section 1.. There is hereby created a commission of and for the City of Batesville,
Arkansas, to be known and designated as the "City Planning Commission", which
commission shall consist of nine (9) members who shall serve without compensation
and of whom not more than one-third may hold any other municipal office or
appointment.
Section 2. The City Planning Commission shall have and is hereby vested with
all the duties, powers and functions as set forth and prescribed by Act 186 of
the Acts of the General Assembly for 1957.
Section 3. The Members of the City Planning Commission shall be named and appoint-
ed by the Mayor, subject to confirmation and approval by the City Council.
Section 4. The terms of office of the members of the City Planning Cormiission
shall be for three (3) years; provided, however, the initial appointments to
the commission shall be three members each for a one year term, three members
each for a two year term and three members each for a three year term. As vacan-
cies occur on said Commission, for whatever cause, said vacancies shall be filled
in the manner herein provided, and said appointees, as well as all initial appointees
hereunder, shall hold office until their successors are appointed and confirmed.
Section 5. It is ascertained and declared that municipal planning is sorely needed,
and the lack thereof endangers the health, safety, business and industrial prog-
ress, and the general well being of the inhabitants of the City of Batesville. It
is therefore declared that an emergency exists, that this ordinance is necessary
for the immediate preservation of the publicpeace, health, safety and well
being, and that this ordinance shall take effect and be in force from and after
passage and publication.
